A night security guard who was paid under a comprehensive wage system (포괄임금제, a fixed monthly wage arrangement that bundles in overtime and holiday pay in advance) sued his employer for additional overtime and holiday pay. The Korean Supreme Court (대법원) ruled in favor of the employer, holding that a 'monitoring-type worker' (감시적 근로자) approved by the Labor Relations Commission (노동위원회) is not entitled to statutory overtime or holiday pay, and that a comprehensive wage agreement is valid as long as it does not disadvantage the worker.

Key takeaways
  • CaseA night security guard paid under a comprehensive (all-inclusive) wage system demanded additional overtime and holiday pay.
  • OutcomeThe Supreme Court rejected the claim, ruling that approved monitoring-type workers are exempt from statutory overtime/holiday pay rules and that the comprehensive wage arrangement was valid since it caused no disadvantage to the worker.
  • LessonEmployers using comprehensive wage systems for monitoring-type roles (e.g., security guards) should obtain proper Labor Relations Commission approval and ensure the total pay is not less favorable than statutory entitlements to avoid future wage disputes.
Issues
  • Validity of wage payment contracts using a comprehensive wage system (포괄임금제)
  • Whether employers are obligated to pay overtime and holiday work allowances to monitoring-type workers (감시적 근로자)
  • Whether employee consent is required when an employer applies for Labor Relations Commission approval of monitoring-type worker status
Key reasoning

Under the Labor Standards Act (근로기준법), workers classified as 'monitoring-type' or 'intermittent' employees—such as night security guards—can be exempted from the standard working-hour regulations if the employer obtains approval from the Labor Relations Commission. Once this approval is granted, the employer is not legally obligated to pay separate overtime or holiday work allowances to that employee. Additionally, a comprehensive wage system, which pays a fixed lump sum covering base pay along with anticipated overtime and holiday pay, is valid under Korean law provided it does not result in the worker receiving less than what statutory calculations would otherwise require. Since the guard's overall compensation was not shown to be disadvantageous compared to itemized statutory pay, the court found no violation.

Summary of Decision (English, AI translation)

[1] In principle, when an employer concludes an employment contract with an employee, the employer should determine the basic wage and then pay various allowances in addition thereto based on that basic wage. However, in consideration of working hours, the form of work, and the nature of the duties, an employer may, for convenience of calculation and to encourage employees' motivation to work, conclude a wage payment contract under the so-called comprehensive wage system (포괄임금제), whereby the basic wage is not calculated in advance and instead the amount combining various allowances is fixed as a monthly salary or daily wage, or a fixed amount is paid each month as various allowances. Such a contract cannot be deemed invalid where it is not disadvantageous to the employee and is found to be justifiable in light of all the relevant circumstances.

[2] Where the duties performed by an employee essentially consist of surveillance/monitoring work involving little physical or mental strain, thereby constituting "monitoring work" (감시적 근로) under Article 49, Item 3 of the former Labor Standards Act (근로기준법) (before its full amendment by Act No. 5309 of March 13, 1997), if the employer has obtained approval from the Labor Relations Commission (노동위원회) for exclusion from the application of the statutory provisions concerning working hours, etc., the employer is not obligated to pay the employee overtime allowance or holiday work allowance under the statutory provisions. In light of the fact that, where approval has been obtained from the Labor Relations Commission for monitoring work, the application of the statutory provisions concerning working hours, holidays, and rest periods is excluded pursuant to Article 49 of the former Labor Standards Act, even if the rules of employment (취업규칙) contain provisions concerning working hours, overtime work, weekly holidays, etc., and there is no provision excluding their application, once the employer has obtained approval for exclusion from application of the statutory provisions, the provisions of the Labor Standards Act or the rules of employment concerning overtime and holiday work cannot be applied to the employee.

[3] Where an employee falls under the category of a monitoring worker by reason of the nature of the duties, and approval of the Labor Relations Commission as provided under Article 49, Item 3 of the former Labor Standards Act has been obtained, the provisions concerning working hours, holidays, and rest periods under Chapters 4 and 5 of the same Act do not apply; and the consent of the employee is not required for the application for approval of such exclusion from application.

[Plaintiff, Appellant] Plaintiff
[Defendant, Appellee] Baekyang Paint Chemical Industry Co., Ltd. (Attorney Lee Il-bin, counsel for the defendant)
[Judgment Below] Seoul High Court Judgment 97Na54606 dated December 3, 1998

[Order]

The appeal is dismissed.
The costs of the appeal shall be borne by the Plaintiff.

[Reasoning]

The grounds of appeal (including the supplementary brief on grounds of appeal submitted after the expiration of the period for submitting grounds of appeal, to the extent it supplements the grounds of appeal) are examined.

1. In principle, when an employer enters into a labor contract with an employee, the employer should determine a basic wage and pay various allowances in addition thereto based on that basic wage. However, in cases where, taking into account working hours, forms of work, and the nature of duties, a wage payment contract is concluded under a so-called comprehensive (lump-sum) wage system—whereby, for convenience of calculation and to encourage employees' motivation to work, the basic wage is not calculated in advance but rather a monthly salary or daily wage amount combining various allowances is fixed, or a fixed amount is paid each month as various allowances—such a contract cannot be deemed invalid where it does not disadvantage the employee and is found to be justified in light of all the circumstances (see Supreme Court Decision 96Da24699 delivered on March 24, 1998).

According to the record, it can be seen that: although the Plaintiff's age exceeded the retirement age limit set forth in the Defendant company's employment rules, due to the consideration of the Plaintiff's maternal cousin, Nonparty 1, who managed the Defendant company, the Plaintiff joined the Defendant company as a security guard on December 19, 1989, and entered into a labor contract under which the Plaintiff would work 8 hours a day (from approximately 08:30 to 18:00) and would be paid a special work allowance of at least 50% of the ordinary wage for work performed outside the basic working hours; that, however, due to the circumstances of the company, from the time of joining until his resignation on March 20, 1996, the Plaintiff, contrary to the original labor contract, worked as a night security guard from approximately 18:00 each day until 08:00 the following day, residing in housing facilities within the Defendant company and performing monitoring-type duties such as fire prevention and periodic patrols of the perimeter for about 6 hours a day, spending the remaining time on standby or resting; that, in consideration of the characteristics of the Plaintiff's duties, the Defendant company did not pay holiday work allowance or overtime allowance according to the Plaintiff's actual working days or hours, but instead paid a fixed monthly amount as basic salary and position allowance, etc., regardless of working days or hours, and each January added the annual leave allowance under the name "monthly leave allowance" in the monthly pay statement to the monthly salary amount; and that the Plaintiff also received such payments without any particular objection until his resignation.

Furthermore, in light of the particularity of the Plaintiff's form of work as found above and the legal principles set forth above, it is to be held that, with the Plaintiff's express or implied consent, the wage payment contract was changed to a so-called comprehensive wage system whereby, taking into account working hours, forms of work, and the nature of duties, a fixed monthly salary amount, inclusive of overtime and holiday work allowances, would be paid regardless of the number of working days or hours.

In the same vein, the court below's findings and determination that the contract was changed to a comprehensive wage system under which a fixed monthly salary amount, inclusive of overtime work allowance and holiday work allowance, would be paid, are justified, and there is no illegality of misapprehension of facts in violation of the rules of evidence or misapprehension of the legal principles concerning the comprehensive wage system.

This ground of appeal cannot be accepted.

2. According to the record, it can be seen that: although the Plaintiff worked as a night security guard from approximately 18:00 each day until 08:00 the following day, he resided in housing facilities within the Defendant company and performed monitoring-type duties such as fire prevention and periodic patrols of the perimeter (patrolling on average 6 times a day, each patrol taking an average of 20 minutes) for about 6 hours a day, spending the remaining time on standby or resting; that, in addition, the Plaintiff's wife, Nonparty 2, was in charge of kitchen work at the Defendant company's cafeteria and received a monthly salary from the Defendant company, and the Plaintiff merely occasionally helped with Nonparty 2's kitchen work or voluntarily helped with cleaning the premises of the Defendant company from time to time, which was not work performed pursuant to any instruction from the Defendant company; and that, pursuant to the Defendant company's personnel regulations, on September 7, 1993, the Defendant company obtained approval from the Gyeonggi Provincial Labor Relations Commission for exemption from application under Article 49, Item 3 of the former Labor Standards Act (Labor Standards Act, 근로기준법) (before being enacted as Act No. 5309 on March 13, 1997; hereinafter referred to as the "former Labor Standards Act") for one night security position, on condition that night work allowance be paid.

In light of the above facts, the duties performed by the Plaintiff, being essentially monitoring in nature and involving little physical or mental strain, constitute monitoring-type work under Article 49, Item 3 of the former Labor Standards Act. Therefore, once approval for exemption from the application of the statutory provisions concerning working hours, etc. has been obtained from the Labor Relations Commission as above, the Defendant company bears no obligation to pay the Plaintiff overtime allowance or holiday work allowance pursuant to the statutory provisions (see Supreme Court Decisions 96Da3234 delivered on August 26, 1997, and 96Da30571 delivered on November 22, 1996, etc.).

Moreover, in light of the fact that, where approval has been obtained from the Labor Relations Commission for monitoring-type work, the application of the statutory provisions concerning working hours, holidays, and rest periods is excluded pursuant to Article 49 of the former Labor Standards Act, even if the employment rules provide for working hours, overtime work, weekly holidays, etc., and contain no provision excluding their application, once the Defendant company has obtained approval for exemption from the application of the statutory provisions as above, the provisions of the Labor Standards Act or the said employment rules concerning overtime and holiday work cannot be applied to the Plaintiff (see Supreme Court Decisions 96Da3234 delivered on August 26, 1997, and 96Da30571 delivered on November 22, 1996, etc.).

Furthermore, where a worker falls under the category of monitoring-type worker by the nature of the duties and approval of the Labor Relations Commission is obtained as prescribed in Article 49, Item 3 of the former Labor Standards Act, the provisions concerning working hours, holidays, and rest periods under Chapters 4 and 5 of the same Act do not apply; the employee's consent is not required for the application for exemption from application, contrary to the Plaintiff's argument (see Supreme Court Decision 96Da30571 delivered on November 22, 1996). Also, since there is no statement in the exemption approval document (Exhibit A No. 4) to the effect that its validity is limited to one year, it cannot be said that the validity period of the exemption approval is limited to one year; and although the exemption approval document states, as a condition of the exempted working conditions, that the approval shall lose effect from the time the form of work becomes different from that at the time of approval, there is no evidence in the record to suggest that the Plaintiff's form of work changed from that at the time of approval.

Therefore, in the same vein, the court below's findings and determination—that the Plaintiff is a monitoring-type worker, that on September 7, 1993 the Labor Relations Commission granted approval for exemption from the application of the provisions concerning working hours, holidays, and rest periods except for the night work allowance, and that accordingly, from that point on, the Defendant bears no obligation to pay overtime work allowance and holiday work allowance except for the night work allowance, thereby rejecting the Plaintiff's claims for such allowances, and its findings and determination concerning the night work allowance, annual and monthly leave allowance, and retirement allowance—are justified, and there is no illegality of misapprehension of facts in violation of the rules of evidence or misapprehension of the legal principles concerning the Labor Standards Act, as alleged in the grounds of appeal.

Ultimately, the arguments in the grounds of appeal that are premised on a different view, namely that the provisions of the employment rules concerning working hours, holidays, or rest periods apply to the Plaintiff, cannot be accepted at all.

3. Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the Plaintiff. This judgment is rendered as stated in the Order, with the unanimous consent of the participating Justices.
