This case involved a labor dispute action by the Seoul Metropolitan Subway Corporation's labor union, including a workplace occupation (직장점거) and encouraging passengers to ride without paying fares (무임승차 권유). The Supreme Court (대법원) upheld the constitutionality of provisions restricting strike actions by public-interest enterprises, and ruled that the workplace occupation excluding the employer's control, as well as the fare-evasion campaign, lacked legal justification.

Key takeaways
  • CaseSubway workers occupied the workplace and encouraged passengers to ride for free as part of a labor dispute.
  • OutcomeThe Supreme Court ruled the restrictions on strikes by public enterprises constitutional and found both the workplace occupation and fare-evasion campaign unlawful.
  • LessonEven legitimate labor disputes must use lawful means; excluding the employer's control over facilities or harming third parties can void a strike's legal protection.
Issues
  • Whether the provisions prohibiting certain strike actions under the Labor Dispute Adjustment Act (노동쟁의조정법) are unconstitutional
  • Whether public-interest enterprises are subject to compulsory arbitration
  • The criteria for determining the legality of a strike action
  • Whether the workplace occupation was lawful
  • Whether encouraging passengers to ride without paying fares was a lawful means of dispute action
Key reasoning

The Court held that strike actions by public-interest enterprises (공익사업체) may be restricted for the sake of public welfare, and that the compulsory arbitration system serves as an adequate substitute measure compensating for the restriction on the right to collective action, making the restriction constitutional. To be lawful, a strike action must satisfy legality requirements regarding its subject, purpose, procedure, and means. Because the union's workplace occupation completely excluded the employer's possessory control and the fare-evasion campaign harmed third parties (passengers) and the public interest, neither action met the requirement of lawful means, and thus both were found to lack justification.

Summary of Decision (English, AI translation)

[1] The term "public service" under Article 30, Subparagraph 3 of the Labor Dispute Adjustment Act (勞動爭議調整法), which provides for so-called compulsory arbitration where a decision to refer a dispute to arbitration is made regardless of the intentions of both labor and management, means a business that is indispensable to the daily life of the public or whose suspension or discontinuance would seriously endanger the national economy, i.e., the businesses set forth in Article 4, Subparagraphs 1 through 5 of the same Act. It is clear that the Seoul Metropolitan Subway Corporation falls under such a public service enterprise.

[2] There exists an inherent limitation (that is, a necessity for restriction for the sake of public welfare) preventing either party from freely engaging in industrial action by employees of a public service enterprise or a lockout by the employer in response thereto. The so-called three labor rights, originally proclaimed under Article 33, Paragraph 1 of the Constitution (憲法), are fundamental rights of subsistence that emerged as a new-era policy modifying the liberal legal principles of civil law, in order to enable substantive equality between employers and employees through the establishment of collective labor relations. Accordingly, these three labor rights must all be equally respected and protected, and there can be no difference in weight among them. However, in light of the purpose of the right of subsistence, which is to improve working conditions, the right to collective bargaining is the most central of these three labor rights. Therefore, so long as workers are properly guaranteed the right to collective bargaining, even if the right to collective action, which serves to secure that right, is restricted, such restriction cannot be regarded as infringing upon the essential content of the right, provided that it is limited to the minimum extent unavoidably necessary and that reasonably substantial compensatory measures, deemed appropriate in light of social norms, are provided. Looking at Article 30, Subparagraph 3 and Article 31 of the Labor Dispute Adjustment Act, when the grounds set forth in these provisions arise, the right to industrial action of both labor and management is restricted and prohibited for a short period of 15 days; thereafter, however, negotiations between labor and management may be handled by the Arbitration Committee, an independent and expert administrative body possessing quasi-judicial (adjudicative) authority, which takes charge of the arbitration case from a neutral standpoint and may render an arbitration award. Once such an award becomes final, it has the same effect as a collective agreement. Given that the right to industrial action is a right meant to facilitate collective bargaining that has reached an impasse, and that it should ultimately be understood as aiming to bring about a collective agreement through collective bargaining, the above arbitration award system cannot but be regarded as a substantial compensatory measure restricting the right to collective action guaranteed under Article 33, Paragraph 1 of the Constitution. Consequently, it is difficult to deny the constitutionality, under Article 37, Paragraph 2 of the Constitution, of the provisions of Article 30, Subparagraph 3 and Article 31 of the Labor Dispute Adjustment Act.

[3] Even in the cases under Article 30, Subparagraphs 1 and 2 of the Labor Dispute Adjustment Act, the exercise of the right to industrial action is, in the form of the statutory text, prohibited pursuant to Article 31 of the same Act. However, Article 30, Subparagraphs 1 and 2 of the same Act do not constitute the only means by which the holder of the right to industrial action can bring about the conclusion of a collective agreement with the employer; rather, the path remains open for such holder to readily choose the mediation procedure set forth in Chapter 4 of the same Act, which, unlike Article 31, does not entail a prohibition on the exercise of the right to industrial action. Therefore, it cannot be said that the prohibitive measure under Article 31 of the same Act infringes upon the essential content of the right to industrial action, as applied to a group of workers who have chosen the path under Article 30, Subparagraphs 1 and 2 of the same Act.

[4] The term "assertions between the parties to a labor relationship" concerning working conditions, as used in the definition of "labor dispute" under Article 2 of the Labor Dispute Adjustment Act, includes assertions relating to either individual labor relations or collective labor relations, and encompasses not only assertions of rights under a collective agreement or an employment contract (a rights dispute) but also assertions aimed at forming a new agreement concerning such matters (an interests dispute). Accordingly, the subject matter of arbitration by the Arbitration Committee includes both interests disputes and rights disputes.

[5] A worker's exercise of the right to industrial action is exempted from illegality under criminal law, and hence not subject to punishment, only when it is legitimate. The legitimacy of an industrial action requires, first, that it be conducted by a person who may be a subject of collective bargaining; second, that it be conducted for the purpose of facilitating autonomous negotiation between labor and management; third, that it commence when the employer has refused to engage in collective bargaining regarding the workers' specific demands for improvement of working conditions, or has, during collective bargaining, given a response rejecting such demands, and that, absent special circumstances, it be preceded in principle by advance notice; and fourth, that the manner of exercising the right to industrial action must consist of a total or partial suspension of the provision of labor, and must, as a matter of course under the principle of good faith governing labor relations, comply with the principle of fairness and be harmonized with the employer's ownership and other property rights over the enterprise's facilities. The use of violence is not permissible, as it contravenes the fundamental principle of the legal order concerning physical freedom and safety. In particular, since the right to industrial action, in the context of collective bargaining which has the character of a collective transaction of labor, is a right to exert economic pressure by preventing the collective use of labor, and is also a right to obstruct the employer from using other labor or securing alternative business connections in order to maintain and strengthen such economic pressure, "industrial action" as an act protected by the right to industrial action means an act by which a group of workers, for the purpose of demonstrating or achieving their demands, completely or incompletely suspends the provision of labor, and, as necessary, engages in picketing to maintain such suspension of labor or appeals to third parties to refuse to deal with the employer.

[6] Occupation of a workplace by union members can be deemed legitimate only where it is a partial and coexisting occupation that does not exclude the employer's possession and does not obstruct the employer's operations. Accordingly, where the defendants mobilized approximately 660 union members to drive out employees who were on duty and occupied the offices of the Subway Corporation, thereby obstructing the performance of its duties by force, such conduct cannot be deemed legitimate.

[7] The defendants not only failed to undergo, in advance, the vote of union members required as a necessary procedure under Article 12 of the Labor Dispute Adjustment Act, but also, during the cooling-off period prescribed under Article 14 of the same Act, opened the ticket gates at various subway stations throughout Seoul and, through public announcements, encouraged passengers to ride without paying fares, thereby causing them to do so and inflicting damages of KRW 1,620,682,940 in fares upon the Subway Corporation. Such conduct not only fails to satisfy the fourth criterion among the general standards for the legitimacy of the right to industrial action set forth in item [5] above, but rather constitutes an abuse of the right to industrial action and lacks legitimacy.

[8] For union activities to be legitimate, they must, except where separately permitted under the rules of employment or a collective agreement, or where there exists a practice or the employer's consent, be conducted outside working hours; union activities within the workplace must comply with reasonable regulations or restrictions based on the employer's facility management authority; and even where union activities are conducted outside working hours and outside the workplace, the worker's duty of good faith under the labor contract (the duty to have regard for the employer's interests) extends thereto and must likewise be observed. Accordingly, where, during working hours, the defendants, acting jointly with union officers, destroyed office fixtures within the Subway Corporation's offices and painted graffiti such as "Labor Liberation," "Non-party 1, Step Down," and "Yankee Go Home" in some 200 locations, including on corridor stairways and office walls, using red paint and spray paint, thereby causing property damage requiring repair costs of KRW 42,900,000, such conduct falls outside the scope of the legitimacy of the right to union activities.

[Appellants] The Prosecutor, the Defendants
[Defense Counsel] Attorney Choi Byung-mo
[Lower Court Judgment] Seoul Criminal District Court Decision 89No5044, decided December 7, 1989

[Order]

The appeals filed by the Defendants and the Prosecutor are all dismissed.
Ninety-six (96) days of the pre-sentencing detention period after the appeal shall be credited toward the sentence imposed on Defendant 1 by the lower court judgment.

[Reasoning]

1. As to the grounds of appeal raised by Defense Counsel and Defendant 1,

(1) The argument is that Articles 47 and 31 of the Labor Dispute Mediation Act (노동쟁의조정법, hereinafter abbreviated as the "Mediation Act") infringe upon the essential content of the right to collective action guaranteed under Article 33(1) of the Constitution, and that, since such infringement cannot be justified even under Article 37 of the Constitution, these provisions are unconstitutional; and that the lower court's judgment, which applied these provisions of the Mediation Act to the Defendants, therefore constitutes a violation of law affecting the judgment.

We examine this as follows. Since Article 47 of the Mediation Act is a penal provision applicable to those who violate Article 31 of the same Act, the argument ultimately reduces to the claim that Article 31 of the Mediation Act violates the constitutional provisions cited in the argument. Article 31 of the Mediation Act provides that once a case is referred to arbitration due to the occurrence of a cause for commencement of arbitration under Article 30 of the same Act, no dispute action may be taken for fifteen days. For convenience, we shall consider this issue by dividing it into two categories: the case under Article 30, Item 3 of the Mediation Act, and the cases under Items 1 and 2 of the same Article.

(a) Article 30, Item 3 of the Mediation Act concerns so-called compulsory arbitration applicable only to public-interest businesses, whereby a referral to arbitration is ordered regardless of the wishes of either labor or management of the business concerned. It is clear from Article 4 of the same Act that "public-interest businesses" mean businesses under Article 4, Items 1 through 5 of the Mediation Act—that is, businesses that are indispensable to the daily life of the public or whose suspension or discontinuance would seriously endanger the national economy. It is beyond dispute that the Seoul Metropolitan Subway Corporation, the business entity to which the Defendants in this case belong, falls within such public-interest businesses.

Considering together the provisions of Article 10(1), first clause, Article 34(1) and (2), Article 35(1), first clause, Article 37(1) and (2), Article 119(2), and Article 23(2) of the Constitution, as well as the purposes for which they were enacted, it may be seen that the State and all citizens of our country bear the duty to maintain, promote, and respect the welfare of the people, and that this duty also forms an essential foundation for the welfare of each individual citizen. Under such an economic and social system, workers engaged in public-interest businesses—whose operations directly affect the daily lives of the public—can only carry on the business concerned through the joint efforts of the employer and the employees. In view of this, both dispute action by employees of such public-interest business entities and, correspondingly, lockouts by employers, are subject to inherent limitations that neither side may exercise arbitrarily (in other words, there is a necessity for restriction in the interest of public welfare).

However, Article 37(2) of the Constitution provides that "the freedoms and rights of citizens may be restricted by law only when necessary for national security, the maintenance of law and order, or public welfare, and even when such restriction is imposed, it shall not violate the essential aspect of the freedom or right." Accordingly, the above-mentioned inherent limitation must be embodied in positive law (Articles 31, 3, and 17 of the Mediation Act correspond to this), and in addition, (ㄱ) it must be the minimum necessary and unavoidable measure, and (ㄴ) it must not infringe upon the essential content of the right (the right to collective action) as proclaimed by the constitutional provision, in order not to violate the same constitutional provision. We now examine points (ㄱ) and (ㄴ).

The so-called three labor rights proclaimed under Article 33(1) of the Constitution are fundamental rights of survival that emerged as a new-era policy modifying the liberal principles of civil law, so as to make possible substantive equality between employer and employee through the establishment of collective labor relations. All three of these rights must be equally respected and protected, and no hierarchy of importance can be established among them; nevertheless, in light of the purpose of these survival rights—namely, the improvement of working conditions—it cannot be denied that, among the three labor rights, the right to collective bargaining is the most central right.

The reason is as follows: under our economic order, which, as is clear from Article 119(1) of the Constitution, is founded fundamentally on respect for the economic freedom and initiative of individuals and enterprises, it is inconceivable that working conditions would be determined unilaterally without negotiation between labor and management. Therefore, recognizing the right to collective bargaining as a legal means by which workers—who are inevitably in an inferior position compared to employers—may overcome that inferiority and secure equality with the employer is nothing less than an essential means for improving working conditions. Accordingly, the right to organize exists as a means of forming a collective body for this purpose, and the right to collective action exists as a right to resolve matters when negotiations reach an impasse.

Viewed in this light, so long as the right to collective bargaining is genuinely secured for workers, the right to collective action, which exists to guarantee that bargaining right, may be restricted, provided that the restriction is to the minimum extent necessary and unavoidable, and provided that a reasonable compensatory measure, as commonly understood in society, has been established; in such a case, it cannot be said that the essential content of the aforementioned right has been infringed.

Since the element of unavoidability is related to the inherent limitation on the right to dispute action discussed above, we now examine the remaining points. Under Article 30, Item 3 and Article 31 of the Mediation Act, when the relevant cause arises, dispute action by both labor and management is restricted and prohibited for the short period of fifteen days, in light of Articles 3, 15, and 17 of the same Act. However, as shown in Articles 32 through 39 of the same Act, subsequent negotiations between labor and management are handled by the Arbitration Committee, an independent and specialized administrative body possessing quasi-judicial (adjudicatory) authority, which handles the arbitration case from a neutral standpoint and may render an arbitration award; and once such award becomes final, it has the same effect as a collective agreement (Article 39(2) of the Mediation Act). As noted above, the right to dispute action is a right that serves as a means of facilitating collective bargaining that has reached an impasse, and its ultimate purpose must be understood as bringing about a collective agreement through collective bargaining. In light of this, the arbitration system constitutes a reasonable compensatory measure restricting the right to collective action guaranteed under Article 33(1) of the Constitution. Accordingly, it is difficult to deny the constitutionality of Article 30, Item 3 and Article 31 of the Mediation Act under Article 37(2) of the Constitution.

(b) Next, as to whether Article 30, Items 1 and 2, and Article 31 of the Mediation Act are unconstitutional: in each of the cases under Article 30, Items 1 and 2 of the same Act, the exercise of the right to dispute action is likewise formally prohibited under Article 31. However, whether such prohibition of the exercise of the right to dispute action in each such case infringes upon the essential content of the right under Article 37(2) of the Constitution is determined, apart from the considerations of minimum necessity, unavoidability, and the existence of a socially reasonable compensatory measure discussed in (a) above, also by whether the holder of the right (the collective body of workers) is unable to avoid the relevant statutory prohibition at issue (Article 31 of the Mediation Act) in exercising that right. Viewed in this light, Article 30, Items 1 and 2 of the Mediation Act do not constitute the sole means by which the right-holders may bring about a collective agreement with the employer; rather, the law leaves open the path of readily choosing the mediation procedure under Chapter 4 of the same Act, which does not entail the prohibition on dispute action under Article 31. Accordingly, it cannot be said that the prohibition under Article 31 of the same Act infringes upon the essential content of the right to dispute action, as applied to a collective body of workers who, rather than choosing that path, chose the path under Article 30, Items 1 and 2 of the same Act. Viewed in this light, it cannot be concluded that the legislative discretion exercised in enacting Article 31 of the Mediation Act exceeds the limits of the essential content of the right to collective action under Article 33(1) of the Constitution, or constitutes an abuse or infringement of reasonable legislative discretion.

(c) Furthermore, Article 47 of the Labor Dispute Mediation Act is merely a penal provision applicable to violations of Article 31 of the same Act, and it goes without saying that this provision does not constitute a violation of the Constitution.

The argument further criticizes the referral-to-arbitration decision as unlawful, on the premise that matters subject to arbitration by the Arbitration Committee are limited to so-called "interest disputes" and do not include so-called "rights disputes" such as the one at issue in this case. However, the term "claims between the parties to a labor relationship" concerning working conditions, as used in the definition of "labor dispute" under Article 2 of the Labor Dispute Mediation Act, includes claims relating to either individual labor relations or collective labor relations, and encompasses not only claims asserting rights under a collective agreement or employment contract (rights disputes) but also claims seeking to form a new agreement regarding such matters (interest disputes). From this standpoint, the lower court's judgment, addressing the matter as pointed out in the argument, is acceptable, and no illegality of the kind alleged in the argument can be found therein.

The argument is nothing more than an idiosyncratic view that this Court does not adopt.

(2) The exercise of the right to dispute action, which is one aspect of workers' right to collective action, is exempt from illegality under criminal law—and therefore not punishable—only when it is legitimate (Article 2 of the Trade Union Act (노동조합법)).

The legitimacy of a dispute action requires, first, that it be conducted by persons who may serve as parties to collective bargaining; second, that it be conducted for the purpose of facilitating autonomous negotiation between labor and management; third, that it commence only after the employer has refused to engage in collective bargaining concerning specific demands for improvement of working conditions, or has given a negative response to such demands at the bargaining table, and that, absent special circumstances, it be preceded, in principle, by prior notification (Article 16 of the Mediation Act); and fourth, that the method of exercising the right to dispute action must consist of a full or partial withholding of the provision of labor, and must, as a matter of course under the principle of good faith governing labor relations, conform to the principle of fairness, harmonizing with the employer's ownership and other property rights over the business facilities, and must not involve the exercise of violence, which is impermissible as contrary to the fundamental legal principle of personal liberty and safety (Article 13 of the Mediation Act). What must be borne in mind here is that the right to dispute action is a right to exert economic pressure upon the employer by preventing the collective utilization of labor power in the context of collective bargaining—which has the character of a collective transaction in labor power—thereby leaving the employer no choice but to suspend operations; and it is also a right to obstruct the employer's use of alternative labor or securing of alternative trading partners, in order to maintain and strengthen such economic pressure. Accordingly, "dispute action" as an act protected by the right to dispute action must be understood to mean an act whereby a group of workers, for the purpose of demonstrating or securing acceptance of their demands, wholly or partially suspends the provision of labor, and, where necessary, engages in picketing to maintain such suspension of labor, or appeals to others to refuse to deal with the employer.

Based on the foregoing legal principles concerning workers' right to dispute action, we now examine the Defendants' occupation of the office premises and the alleged breach of trust as found by the lower court in this case.

(a) According to the lower court's judgment, the Defendants named therein, having conspired with other union executives at the date and time specified, to occupy the offices of the Subway Corporation as specified, mobilized approximately 660 union members, expelled the employees who were working, and occupied the offices, thereby obstructing by force the performance of duties by Deputy Director of General Affairs, non-indicted person 2, and 109 other persons. This finding of fact is acceptable as it stands, and no illegality of the kind alleged in the argument can be found therein.

However, as is clear from the purpose of the right to dispute action set forth above, such occupation of the workplace can be considered legitimate only insofar as it is a partial and coexisting occupation that does not exclude the employer's possession or obstruct operations. Accordingly, without any need to examine the other points, the lower court's judgment finding guilt on this point is correct, and no error exists therein.

(b) According to the lower court's judgment, the Defendants, pursuant to a resolution adopted at an expanded meeting of union executives on the date specified, opened the ticket gates of each subway station in Seoul during the period specified and, through announcements, encouraged passengers to ride without paying fares, thereby causing the Corporation to suffer fare losses amounting to KRW 1,620,682,940. Such conduct was carried out not only without going through the prior union member vote required as a necessary procedure under Article 12 of the Labor Dispute Mediation Act, but also during the cooling-off period prescribed under Article 14 of the same Act. This finding of fact by the lower court is likewise acceptable as it stands, and no illegality of the kind alleged in the argument can be found therein. Moreover, the lack of legitimacy of the Defendants' conduct is not only inconsistent with the fourth criterion of legitimacy for dispute action discussed above, but in fact constitutes an abuse of the right to dispute action, and thus lacks legitimacy. Accordingly, the lower court's judgment finding this conduct to constitute a crime is correct, and no illegality of the kind alleged in the argument can be found therein.

(3) When a worker organizes or joins a trade union, the worker possesses, as an aspect of the right to collective action, both the right to dispute action and the right to union activities. This is clear from the fact that Article 2 of the Trade Union Act confirms criminal exemption broadly for "legitimate acts conducted through collective bargaining or other conduct of a trade union for the purpose of achieving the objectives set forth in Article 1," without limiting such exemption specifically to dispute action that is legitimate. It is also necessary to recognize such a right in practice, because there is a need to guarantee, within certain limits, activities of the collective body other than dispute action and collective bargaining (typically, activities such as posting or distributing leaflets, wearing armbands, holding assemblies, wearing headbands, giving speeches, and the like).

It is clear from the foregoing that such right to union activities, like the right to dispute action, is exempt from criminal liability only within the scope in which it is legitimate; and this right, like the right to dispute action, must satisfy requirements of legitimacy in all respects, including subject, purpose, and method of exercise. Here, however, we shall limit our discussion to the general criteria for the legitimacy of the method of union activities, to the extent necessary for judging the portion of this case concerning the violation of the Act on the Punishment of Violence, etc. For union activities to be legitimate, absent a separate permitting provision in the rules of employment or the collective agreement, or the existence of a custom or the employer's consent, such activities must be conducted outside working hours; and with respect to union activities within the workplace, they must comply with reasonable regulations or restrictions based on the employer's right to manage its facilities. Even where union activities are conducted outside working hours and outside the workplace, the worker's duty of good faith under the employment contract (the duty to have regard for the employer's interests) extends to such activities as well, and this duty must likewise be fulfilled.

In this case, according to the reasoning of the lower court's judgment, the Defendants named therein, together with union executives, during working hours on the date specified, jointly damaged office equipment on the third-floor headquarters, fifth floor, and seventh floor offices of the Subway Corporation, and using approximately 40 cans of red paint and spray paint, wrote graffiti such as "Labor Liberation," "Kim Myeong-nyeon, Step Down," and "Yankee Go Home" at approximately 200 locations on corridor stairways, office walls, and elsewhere, thereby causing property damage requiring repair costs of KRW 42,900,000. There is no illegality of the kind alleged in the argument in the process by which this fact was found, and it is clear, without need for further detailed explanation beyond what has been stated above, that these established facts fall outside the scope of the legitimacy of the right to union activities discussed above. Accordingly, the lower court's judgment finding guilt on this point is correct, and no illegality of the kind alleged in the argument can be found therein.

2. As to the grounds of appeal raised by the Prosecutor,

The lower court's acquittal of Defendant 2 on the portion of the indictment specified therein, on the ground that there was no proof of the criminal facts, is correct, and no illegality due to insufficient examination or misapprehension of the rules of evidence, as alleged in the argument, can be found therein.

3. Accordingly, all grounds of appeal are without merit, and this appeal is dismissed. The participating Justices unanimously agreed to credit a portion of Defendant 1's pre-conviction detention period toward the principal sentence imposed by the lower court, and the judgment is rendered as set forth in the Order.
