In this case, taxi company workers claimed the difference in overtime allowance (연장근로수당) and night shift allowance (야간근로수당) they were owed. The Supreme Court (대법원) reversed and remanded the lower court's ruling, addressing how to calculate these extra allowances when the ordinary wage (통상임금) falls below the minimum wage (최저임금). The Court held that the minimum wage and ordinary wage are separate legal concepts, and when the ordinary wage is lower than the minimum wage, a new ordinary wage must be recalculated by increasing the comparison wage—rather than simply using the minimum wage itself as the basis for calculating extra allowances.

Key takeaways
  • CaseTaxi company workers sought the difference in overtime and night shift allowances, since their ordinary wage was lower than the minimum wage.
  • OutcomeThe Supreme Court ruled that the minimum wage cannot simply be used as the basis for calculating extra allowances; instead, a newly recalculated ordinary wage—reflecting the wage increase needed to meet the minimum wage—must be used.
  • LessonWhen an employee's ordinary wage falls below the minimum wage, employers must first increase wages to recalculate a new ordinary wage, and then use that figure as the basis for calculating extra allowances.
Issues
  • The relationship between the ordinary wage (통상임금) and the minimum wage (최저임금)
  • How to calculate overtime allowance (연장근로수당) and night shift allowance (야간근로수당) when the ordinary wage falls below the minimum wage
  • The scope of the comparison wage used to determine minimum wage compliance
Key reasoning

The minimum wage (최저임금) and the ordinary wage (통상임금) serve different functions and are calculated using different methods, making them distinct legal concepts. Even when the ordinary wage falls below the minimum wage, the court cannot simply substitute the minimum wage as the basis for calculating extra allowances such as overtime or night shift pay. Instead, when the total comparison wage is increased to meet the minimum wage requirement, each individual wage component must be proportionally increased. The extra allowances must then be calculated based on this newly recalculated ordinary wage, not the minimum wage itself.

Summary of Decision (English, AI translation)

[1] The Minimum Wage Act (최저임금법) provides in Article 6(1) that "an employer shall pay wages not less than the minimum wage amount to workers subject to the minimum wage," and in Article 6(4) provides that the following shall not be included in the wages under paragraph (1): "wages other than those paid regularly at least once a month, as determined by the Minister of Employment and Labor (item 1)," "wages other than those paid for prescribed working hours or prescribed working days, as determined by the Minister of Employment and Labor (item 2)," and "other wages that the Minister of Employment and Labor separately determines as inappropriate to include in the minimum wage amount (item 3)." Accordingly, the Enforcement Rule of the Minimum Wage Act (최저임금법 시행규칙) sets forth in [Attached Table 1] to Article 2 the scope of wages not to be included in the minimum wage. Therefore, whether the wages paid fall short of the minimum wage must be determined by comparing the minimum wage amount with the wage amount remaining after excluding, from the wages paid, the wages or allowances set forth in Article 6(4) of the Minimum Wage Act and [Attached Table 1] to Article 2 of its Enforcement Rule (i.e., the wages for purposes of applying the minimum wage, hereinafter referred to as the "wages subject to comparison"). Meanwhile, the Labor Standards Act (근로기준법) provides for "ordinary wages," which serve as the standard wage for guaranteeing the minimum amount of average wages—which may increase or decrease depending on actual working hours or work performance, etc.—and for calculating additional pay for overtime, night, and holiday work, dismissal notice allowance, and annual leave allowance, etc. Such "ordinary wages" refer to fixed wages that are paid regularly and uniformly to workers as consideration for prescribed work or total work.
As such, since the minimum wage or the wages subject to comparison for purposes of applying the minimum wage constitute a separate concept from ordinary wages, differing in function and method of calculation, the mere fact that an employer must pay wages not less than the minimum wage amount to workers subject to the minimum wage cannot be construed as meaning that the ordinary wages themselves are directly floored at the minimum wage amount. However, where the total amount of wages subject to comparison for a worker subject to the minimum wage is less than the minimum wage amount, the total amount of wages subject to comparison must be increased to the minimum wage amount, and accordingly, each individual wage item included in the wages subject to comparison would also be increased; the ordinary wages could then be newly calculated based on those wage items, among the increased individual wages, that constitute ordinary wages.

[2] In a case where Eul et al., employees of Gap limited liability company, sought against Gap company payment of the difference between overtime allowance and night-shift allowance calculated based on the hourly minimum wage amount prescribed by the Minimum Wage Act and the respective allowances actually paid, among the base pay, seniority allowance, and weekly holiday allowance that the court below determined to be included in the wages subject to comparison for purposes of applying the minimum wage, only the base pay and seniority allowance appear to constitute ordinary wages. The court below should have held that, since the total amount of wages subject to comparison for purposes of applying the minimum wage is increased to the minimum wage amount pursuant to the Minimum Wage Act, the individual wage items included in the wages subject to comparison—namely, base pay, seniority allowance, and weekly holiday allowance—are also increased accordingly, and, on that premise, should have newly calculated the ordinary wages based on the base pay and seniority allowance, which constitute ordinary wages among the increased individual wage items, and then ordered payment of the difference between the overtime allowance and night-shift allowance calculated based on the newly calculated ordinary wages and the respective allowances actually paid. However, the court below erred by holding that, where the ordinary wages are less than the minimum wage amount, the overtime allowance and night-shift allowance must be calculated based on the hourly minimum wage amount prescribed by the Minimum Wage Act, thereby committing an error of misapprehending the applicable legal principles, among other errors.

[Plaintiff, Appellee]

[Defendant, Appellant] Ilkwang Taxi Co., Ltd. (Limited Liability Company) (Attorneys for the defendant: Yangheon Law Firm, Attorney Kim Seon-hye and one other)

[Judgment Below] Busan High Court (Changwon) Judgment 2013Na2422, decided June 26, 2014

[Order]

The part of the judgment below against the Defendant is reversed, and this part of the case is remanded to the Busan High Court.

[Reasoning]

The grounds of appeal (including the supplementary brief on grounds of appeal submitted after the deadline for submitting the grounds of appeal, to the extent it supplements the grounds of appeal) are examined.

1. As to the second ground of appeal
In light of the circumstances stated in its judgment, the court below determined that the Plaintiffs' claim seeking payment of wages, etc., calculated based on the collective agreement and the wage agreement at issue in this case, could not be deemed contrary to the principle of good faith or an abuse of rights, and that it was difficult to view the collective agreement at issue as having been rescinded merely because the circumstances alleged by the Defendant showed that a significant change of circumstances, unforeseeable at the time the union branch and the Defendant concluded the collective agreement at issue, had occurred and negotiations for a new collective agreement had broken down.

Upon examination in light of the relevant legal principles and the record, the above determination by the court below is justified, and there is no error therein, such as a misunderstanding of the legal principles concerning the effect of the collective agreement at issue, as alleged in the grounds of appeal.

2. As to the third ground of appeal
The court below determined that the overtime allowance and night-shift allowance at issue, being allowances paid on the premise of night work or work exceeding a certain number of hours, constitute wages other than wages paid for prescribed working hours, and thus are not included in the wages to be compared for the purpose of applying the minimum wage.

In light of the relevant legal principles and the record, the above determination by the court below is justified, and there is no error therein, such as a misunderstanding of the legal principles concerning the calculation of the comparison wage for the purpose of applying the Minimum Wage Act (최저임금법), as alleged in the grounds of appeal.

3. As to the fourth ground of appeal
A. As to the overtime allowance and night-shift allowance portion

(1) Article 6(1) of the Minimum Wage Act provides that "an employer shall pay wages not less than the minimum wage amount to workers subject to the minimum wage," and Article 6(4) of the same Act provides that wages other than wages paid regularly at least once a month as determined by the Minister of Employment and Labor (item 1), wages other than wages paid for prescribed working hours or prescribed working days as determined by the Minister of Employment and Labor (item 2), and other wages separately determined by the Minister of Employment and Labor as inappropriate to be included in the minimum wage amount (item 3), shall not be included in the wages under paragraph (1). Accordingly, the Enforcement Rule of the Minimum Wage Act (최저임금법 시행규칙) sets forth, in [Attached Table 1] of Article 2, the scope of wages not to be included in the minimum wage. Therefore, whether the wages paid fall short of the minimum wage must be determined by comparing the minimum wage amount with the amount of wages excluding the wages or allowances set forth in Article 6(4) of the Minimum Wage Act and [Attached Table 1] of Article 2 of its Enforcement Rule (hereinafter referred to as "comparison wage" as the wage for the purpose of applying the minimum wage) (see Supreme Court Decision 2006Da64245, decided January 11, 2007). Meanwhile, the Labor Standards Act (근로기준법) provides for "ordinary wages" as the standard wage for guaranteeing the minimum amount of average wages, which may increase or decrease according to actual working hours or work performance, and for calculating additional pay for overtime, night, and holiday work, dismissal notice allowance, and annual leave allowance, etc.; such "ordinary wages" mean fixed wages that are regularly and uniformly paid to workers as consideration for prescribed work or total work (see Supreme Court en banc Decision 2012Da89399, decided December 18, 2013, etc.).

As such, the minimum wage or the comparison wage for the purpose of applying the minimum wage is a separate concept from ordinary wages, differing in function and calculation method, and therefore it cannot be said that, merely because an employer must pay wages not less than the minimum wage amount to a worker subject to the minimum wage, the ordinary wage itself is thereby set with the minimum wage amount as its floor. However, where the total comparison wage of a worker subject to the minimum wage is less than the minimum wage amount, the total comparison wage must be increased to the minimum wage amount, and accordingly, the individual wages included in the comparison wage are also increased; the ordinary wage may then be newly calculated based on those wages, among the increased individual wages, that constitute ordinary wages.

(2) In light of the following circumstances, the court below determined that, with respect to the overtime allowance and night-shift allowance of the remaining Plaintiffs, excluding Plaintiff 4, Plaintiff 6, and Plaintiff 8 (hereinafter referred to as "the remaining Plaintiffs"), the amounts to be paid should also be calculated by multiplying the payment rate set forth in the wage agreement at issue not by the hourly wage set forth in the wage agreement at issue but by the hourly minimum wage amount set forth in the Minimum Wage Act.

(A) The Defendant agreed, under the wage agreement at issue, to pay the remaining Plaintiffs overtime allowance and night-shift allowance calculated by multiplying the payment rate determined based on the hourly wage according to the number of working days.

(B) Under the Minimum Wage Act, the portion of a labor contract between a worker subject to the minimum wage and an employer that sets wages below the minimum wage amount is null and void, and in such case, the invalidated portion is deemed to have set wages equal to the minimum wage amount prescribed by the Minimum Wage Act.

(C) Since the sum of the basic pay, weekly holiday allowance, and seniority allowance included in the comparison wage for the purpose of applying the minimum wage, among the wages paid by the Defendant to the remaining Plaintiffs, falls short of the minimum wage amount, the Defendant is obligated to pay the remaining Plaintiffs the difference pursuant to the Minimum Wage Act.

(3) However, the above determination by the court below is difficult to accept as it stands.

Upon examination in light of the above legal principles and the record, it appears that the remaining Plaintiffs are seeking, through this lawsuit, payment of the difference between the overtime allowance and night-shift allowance calculated based on the hourly minimum wage amount set forth in the Minimum Wage Act and the amounts actually paid as such allowances, and that, among the basic pay, seniority allowance, and weekly holiday allowance which the court below determined to be included in the comparison wage for the purpose of applying the minimum wage, only the basic pay and seniority allowance appear to constitute ordinary wages. If so, the court below should have, on the premise that the individual wages included in the comparison wage—namely, the basic pay, seniority allowance, and weekly holiday allowance—are also increased as the total comparison wage for the purpose of applying the minimum wage is increased to the minimum wage amount under the Minimum Wage Act, newly calculated the ordinary wage based on the basic pay and seniority allowance, among the increased individual wages, that constitute ordinary wages, and then ordered payment of the difference between the overtime allowance and night-shift allowance calculated based on the newly calculated ordinary wage and the amounts actually paid as such allowances.

(4) Nevertheless, in calculating the overtime allowance and night-shift allowance, which are to be paid by adding 50/100 of the ordinary wage, the court below, on the premise that where the ordinary wage is less than the minimum wage amount, the overtime allowance and night-shift allowance must be calculated directly based on the minimum wage amount, determined, without following the above method, that the overtime allowance and night-shift allowance at issue must be calculated based on the hourly minimum wage amount set forth in the Minimum Wage Act. This judgment of the court below contains an error affecting the conclusion of the judgment by misunderstanding the legal principles concerning the relationship between the minimum wage and ordinary wages, thereby failing to conduct the necessary deliberation. The ground of appeal pointing this out is well-founded.

B. As to the bonus portion

(1) The court below found that Article 7 of the wage agreement at issue, concluded between the union branch and the Defendant, provides that union members who have worked for at least one year shall be paid a bonus equal to 200% of "average wages," divided and paid quarterly, and then, for the reasons stated in its judgment, determined that, if the wages paid to the Plaintiffs, who are subject to the Minimum Wage Act, under the wage agreement at issue fall short of the minimum wage amount, the "average wages" that serve as the standard for calculating the above bonus must also be increased to the minimum wage amount.

(2) However, the above determination by the court below is difficult to accept, for the following reasons.

(A) According to the record, although the wage agreement at issue provides for payment of a bonus calculated based on "average wages" as described above, it does not separately define the meaning of "average wages." Therefore, the meaning must be reasonably interpreted in accordance with the rule of experience so as to conform to the ideals of social justice and equity, comprehensively considering the content of the relevant wording, the motive and circumstances behind the conclusion of the wage agreement, practice, and the purpose and true intent that the labor union and the employer sought to achieve through the wage agreement (see Supreme Court Decision 2014Da82026, decided October 27, 2016, etc.).

(B) Meanwhile, if "average wages" under the wage agreement at issue means the statutory "average wages" prescribed by the Labor Standards Act, then, as noted above, the total amount thereof would increase due to the application of the Minimum Wage Act to the individual wage items constituting it; however, if it instead means an average amount calculated based only on wages paid during a certain period as agreed between the parties, then, absent special circumstances, the total amount thereof would not change regardless of whether the Minimum Wage Act applies to the individual wage items constituting it.

(C) Therefore, the court below should have examined whether the meaning of "average wages," which serves as the standard for calculating the bonus set forth in the wage agreement at issue, refers to the statutory "average wages" or to an average amount obtained by dividing the total amount of a specific wage paid during a certain period, as agreed under the wage agreement at issue, by the total number of days in the calculation period, and then, based on such examination, determined the merits of the Plaintiffs' claim for unpaid bonuses.

(3) Nevertheless, without conducting a proper examination in this regard, the court below determined that the "average wages" for calculating the bonus at issue must also be increased to the minimum wage amount. This judgment of the court below contains an error of misunderstanding the legal principles concerning the interpretation of the meaning of "average wages," thereby failing to conduct the necessary deliberation.

4. Conclusion
Accordingly, without further examination of the remaining grounds of appeal, the part of the judgment below against the Defendant is reversed, and this part of the case is remanded to the court below for further hearing and determination. This judgment is rendered as set forth in the Order, by the unanimous consent of the participating Justices.
