AI-generated summary for reference only — the Korean original below is authoritative.

A company tried to exclude the long-service allowance (근속수당) and weekly holiday allowance (주휴수당) from the wage base used to check compliance with the minimum wage (최저임금). The Supreme Court held that both allowances, since they are paid regularly as compensation for work, must be included in the wages compared against the minimum wage. It also ruled that any agreement using non-includable allowances to cover a shortfall below the minimum wage is invalid, reversing the lower court's decision and remanding the case for further review.

Key takeaways
  • CaseThe company excluded the long-service allowance and weekly holiday allowance from minimum wage calculations and tried to offset the shortfall using other allowances.
  • OutcomeThe Supreme Court ruled that regularly paid allowances like the long-service and weekly holiday allowances must be included in the minimum wage comparison, and that any agreement violating the Minimum Wage Act is invalid.
  • LessonWhen calculating compliance with the minimum wage, employers must include all wages paid on a regular basis, and cannot use workaround agreements to circumvent minimum wage requirements.
Issues
  • Whether the long-service allowance should be included in the wages compared against the minimum wage
  • Whether the weekly holiday allowance should be included in the wages compared against the minimum wage
  • Whether an agreement compensating for a minimum wage shortfall using allowances not included in minimum wage calculations is valid
Key reasoning

Allowances that are paid on a regular, periodic basis and constitute compensation for work performed—such as the long-service allowance and weekly holiday allowance—must be counted as part of the wages compared against the statutory minimum wage under the Minimum Wage Act (최저임금법). Any wage agreement that conflicts with the Minimum Wage Act, including one that uses non-qualifying allowances to make up for a shortfall, is void. The lower court erred by confusing the concept of 'comparison wage' under the Minimum Wage Act with 'ordinary wage' (통상임금) under the Labor Standards Act (근로기준법), leading to an incorrect judgment.

Summary of Decision (English, AI translation)

[1] Whether wages paid fall short of the minimum wage under the Minimum Wage Act (최저임금법) must be determined by comparing the minimum wage amount with the amount of wages paid excluding the wages or allowances designated under Article 6(4) of the Minimum Wage Act and Article 2 [Attached Table 1] of the Enforcement Rule of the Minimum Wage Act (최저임금법 시행규칙).

[2] A case holding that a length-of-service allowance, which was paid regularly once a month in a uniformly fixed amount determined according to the employee's length of service, with a pro-rated deduction corresponding to the number of days of absence, constitutes wages paid regularly at least once a month for prescribed working hours or working days, and is not in the nature of wages for the employee's living assistance or welfare benefits; and that, on this basis, such length-of-service allowance does not fall under the wages or allowances designated under Article 6(4) of the Minimum Wage Act and Article 2 [Attached Table 1] of the Enforcement Rule of the Minimum Wage Act, and is therefore included in the wages to be counted for the application of the minimum wage.

[3] Article 5(1), items 2 and 3, of the Enforcement Decree of the Minimum Wage Act (최저임금법 시행령) provides that, for wages paid on a weekly or monthly basis, the amount obtained by dividing such wages by the "prescribed weekly or monthly working hours" shall constitute the hourly wage. The weekly holiday allowance, which is wages paid for a paid holiday under a weekly-pay or monthly-pay system, is wages paid regularly at least once a month for prescribed work, and thus cannot be regarded as falling under the "wages or allowances not to be included in the wages subject to comparison" as designated under Article 6(4) of the Minimum Wage Act and Article 2 [Attached Table 1] of the Enforcement Rule of the Minimum Wage Act. Accordingly, in calculating the wages for the purpose of applying the minimum wage, the weekly holiday allowance must be added. Furthermore, since there is no need to take into account the working hours related to the weekly holiday allowance when calculating, as hourly wages, other allowances paid on a weekly or monthly basis apart from the weekly holiday allowance, the "prescribed weekly or monthly working hours" referred to herein means the working hours prescribed under Article 20 of the Labor Standards Act (근로기준법), and this cannot be equated with the "standard number of hours for calculating ordinary wages on a weekly or monthly basis" as calculated under Article 6(2), items 3 and 4, of the Enforcement Decree of the Labor Standards Act (근로기준법 시행령).

[4] Where an employee and an employer agree to include, within the scope of wages for the application of the minimum wage, wages that are not to be included in the wages for the application of the minimum wage, in order to make up for the shortfall below the minimum wage, such wage agreement is null and void as being contrary to Article 6(3) of the Minimum Wage Act.

[Plaintiffs, Appellees] Plaintiff 1 and 10 others
[Defendant, Appellant] Defendant (Attorney Kim Young-cheol, Counsel for the Defendant)
[Judgment Below] Seoul Northern District Court Decision 2006Na34, decided September 6, 2006

[Order]

The judgment below is reversed, and the case is remanded to the Panel Division of the Seoul Northern District Court.

[Reasoning]

The grounds of appeal are examined.

1. As to the First Ground of Appeal

Article 6(1) of the Minimum Wage Act (최저임금법) provides that "an employer shall pay wages of no less than the minimum wage amount to workers to whom the minimum wage applies," and Article 6(4) of the same Act provides that the following shall not be included in the wages under paragraph (1): "wages other than those paid regularly at least once a month, as determined by the Minister of Labor (item 1)"; "wages other than those paid for prescribed working hours or prescribed working days, as determined by the Minister of Labor (item 2)"; and "other wages separately determined by the Minister of Labor as being inappropriate to include in the minimum wage amount (item 3)." Accordingly, [Table 1] of Article 2 of the Enforcement Rule of the Minimum Wage Act (최저임금법 시행규칙) sets forth the scope of wages not to be included in "wages for the application of the minimum wage" (hereinafter "wages subject to comparison"). Therefore, whether the wages paid fall short of the minimum wage must be determined by comparing the minimum wage amount with the amount of "wages subject to comparison," which is the amount of wages paid excluding the wages or allowances set forth in Article 6(4) of the Minimum Wage Act and [Table 1] of Article 2 of the Enforcement Rule of the same Act.

However, according to the facts found in the first instance judgment cited by the court below, the Plaintiffs received, under the name of a long-service allowance, a uniformly determined amount according to their length of service, paid regularly each month, provided that in the case of absence from work, an amount calculated on a pro-rata basis according to the number of days absent was deducted.

If so, such a long-service allowance is a wage paid regularly at least once a month for prescribed working hours or working days, and cannot be said to be a wage in the nature of a subsidy for a worker's living or welfare benefits. Therefore, it does not fall under any of the "wages or allowances not to be included in wages subject to comparison" set forth in Article 6(4) of the Minimum Wage Act and [Table 1] of the Enforcement Rule of the same Act, and should be regarded as included in "wages subject to comparison."

Nevertheless, the court below, confusing the "wages subject to comparison" to be compared with the minimum wage with "ordinary wages" under the Labor Standards Act (근로기준법), determined that since the amount of the long-service allowance at issue in this case varies according to the actual number of days worked by the worker and is not a fixed wage, it cannot be regarded as an ordinary wage, and therefore is not included in the "wages subject to comparison" to be compared with the minimum wage. Such determination by the court below is erroneous in that it misunderstood the scope of "wages subject to comparison" under the Minimum Wage Act, and this error affected the outcome of the judgment (furthermore, it should be noted that Article 5(1), items 2 and 3, of the Enforcement Decree of the Minimum Wage Act (최저임금법 시행령) provides that, with respect to wages paid on a weekly or monthly basis, the amount obtained by dividing such wages by "the number of prescribed working hours per week or per month" shall be regarded as the wage per hour. Since the so-called weekly holiday allowance, which is a wage for paid holidays under a weekly or monthly wage system, is a wage paid regularly at least once a month for prescribed work, it cannot be said to fall under the "wages or allowances not to be included in wages subject to comparison" set forth in Article 6(4) of the Minimum Wage Act and [Table 1] of the Enforcement Rule of the same Act, and therefore the weekly holiday allowance must be added in calculating the wages subject to comparison. Moreover, since there is no need to consider the working hours related to the weekly holiday allowance when calculating other allowances paid on a weekly or monthly basis as wages per hour, the "prescribed working hours per week or per month" referred to herein means the working hours set forth in Article 20 of the Labor Standards Act, and this cannot be equated with the "standard number of hours for calculating ordinary wages per week or per month" calculated pursuant to Article 6(2), items 3 and 4, of the Enforcement Decree of the Labor Standards Act

2. As to the Second Ground of Appeal

Article 6(3) of the Minimum Wage Act provides that "a labor contract concluded between a worker to whom the minimum wage applies and an employer, which stipulates wages below the minimum wage amount, shall be null and void with respect to that portion, and the portion rendered null and void shall be deemed to have stipulated wages identical to the minimum wage amount determined under this Act." As noted above, Article 6(4) of the same Act and Article 2 of the Enforcement Rule of the same Act set forth the "wages or allowances not to be included in wages subject to comparison." Therefore, even if there was an agreement between the worker and the employer to make up for the shortfall below the minimum wage by including "wages not to be included in wages subject to comparison" within the scope of wages subject to comparison, such a wage agreement is null and void as being contrary to the aforementioned provisions of the Minimum Wage Act.

The court below, citing the reasoning of the first instance judgment, rejected the Defendant's assertion that there was an agreement between the Plaintiffs and the Defendant to make up for the shortfall below the minimum wage by paying a training allowance (the portion exceeding KRW 40,000 per month), which could not be included in the wages subject to comparison. Although the explanation given by the court below is somewhat insufficient, its conclusion is justified, and there is no error therein that affected the outcome of the judgment.

3. Conclusion

Therefore, the judgment below is reversed, and the case is remanded to the court below for further hearing and determination. This judgment is rendered as stated in the Order by the unanimous opinion of the Justices participating in the decision.

Justice Yang Seung-tae (Presiding Justice), Ko Hyeon-cheol, Kim Ji-hyeong, Jeon Su-an (Justice in Charge)
