The Supreme Court ruled that dismissing an employee because of labor union activities constitutes an unfair labor practice (부당노동행위) and is therefore void. The employer was ordered to pay the full amount of unpaid wages (including overtime allowances) accrued during the dismissal period, as well as consolation money (위자료, damages for emotional distress) to the worker.

Key takeaways
  • CaseA company dismissed an employee because of his labor union activities and refused to pay his wages.
  • OutcomeThe court ruled that dismissal based on union activity is an unfair labor practice and therefore void, ordering the company to pay all wages owed during the dismissal period plus consolation money.
  • LessonDismissing an employee because of union activity is invalid, and the employer must fully compensate the worker for all wages lost during the wrongful dismissal period.
Issues
  • Whether a dismissal carried out as an unfair labor practice is valid or void
  • The scope of wages an employee can claim when a dismissal is ruled void
  • The circumstances under which an unfair dismissal also constitutes a tort (unlawful act) entitling the worker to damages
Key reasoning

Article 39 of the Trade Union Act (노동조합법) is a mandatory provision, meaning any dismissal that violates it as an unfair labor practice is automatically invalid. Because the dismissal was void, the worker was legally still employed throughout the dismissal period and was entitled to claim the full wages he would have earned under the Labor Standards Act (근로기준법)—not just his base pay, but also all applicable allowances such as overtime pay. The Court further held that when an employer abuses its disciplinary authority in a way that cannot be justified under generally accepted social norms, such wrongful dismissal can also constitute a tort (불법행위), giving rise to liability for damages including emotional distress.

Summary of Decision (English, AI translation)

[1] The provisions prohibiting unfair labor practices under Article 39 of the Trade Union Act (노동조합법) are intended to concretely secure the three fundamental labor rights guaranteed by the Constitution. In light of the fact that penal provisions are established for violations of such provisions, while at the same time Articles 42 and 43 of the same Act provide administrative remedial procedures so that prompt relief may be obtained with respect to unfair labor practices, these provisions are to be construed as mandatory provisions having binding force. Therefore, a juristic act in violation of the above provisions is also invalid under private law, and inasmuch as a juristic act constituting discriminatory treatment against a worker is invalid as an unfair labor practice, there is no need to further determine whether there was a justifiable reason as prescribed in Article 27 of the Labor Standards Act (근로기준법).

[2] Where a dismissal is null and void, the wages that a worker may claim payment of refer to the wages prescribed in Article 18 of the Labor Standards Act, and thus all wages that would be included in the total amount of wages serving as the basis for calculating average wages as referred to in Article 19 of the same Act are included, and such wages are not necessarily limited to ordinary wages.

[3] In a case where an employer, in violation of the mandatory provision prohibiting discriminatory treatment under Article 39 of the Trade Union Act, unjustly dismisses a worker or imposes a disadvantageous disposition on the worker, such that the dismissal or other disposition is null and void, and where the grounds asserted by the employer for imposing such disadvantageous disposition are merely ostensible grounds, and it is clear that, in substance, the employer, with the intention of excluding the worker from the workplace on account of the worker's legitimate labor union activities, deliberately put forward some ostensible ground for dismissal and resorted to the means of disciplinary action to carry out the dismissal or other disadvantageous disposition—such that the abuse of the right to discipline is clearly and utterly unacceptable under sound social norms or common social standards—then the effect is not limited merely to negating the validity of such dismissal or disadvantageous disposition; rather, it amounts to unlawfully inflicting mental suffering upon the other party, and may thus constitute a tort against the worker.

[Defendant, Appellant] Kyunggi Chemical Industry Co., Ltd., Litigation Representatives Attorney Lee Jae-hu and 2 others

[Court Below] Busan High Court Decision 92Na10043 rendered on January 29, 1993

[Order]

The appeal is dismissed.
The costs of the appeal are borne by the Defendant.

[Reasoning]

The grounds of appeal are examined.

As to Ground No. 1

The provision prohibiting unfair labor practices under Article 39 of the Trade Union Act (노동조합법) is intended to concretely secure the three labor rights guaranteed by the Constitution. In light of the fact that, while penal provisions are established for acts in violation thereof, Articles 42 and 43 of the same Act also provide administrative remedy procedures to enable prompt relief of rights with respect to unfair labor practices, this provision is to be interpreted as a mandatory provision having binding effect, and therefore a juristic act in violation of the above provision is also invalid as a matter of private law. Insofar as a juristic act constituting discriminatory treatment against a worker is invalid as an unfair labor practice, there is no need to further determine whether it has justifiable cause under Article 27 of the Labor Standards Act (근로기준법).

Accordingly, it was proper for the court below, having found through the evidence it adopted that both the Defendant's order placing the Plaintiff on standby and the dismissal of the Plaintiff were finally determined to constitute unfair labor practices, to hold that both were invalid, and there is no error of misapprehension of legal principles or incomplete deliberation as alleged in the grounds of appeal. This ground of appeal is without merit.

As to Grounds No. 2 and 3

Where a dismissal of a worker becomes invalid, the employment relationship is deemed to have continued validly during that period, and since the worker's inability to provide labor during the period of dismissal is attributable to the employer who wrongfully dismissed the worker, the worker may claim payment of the entire wages that would have been received as the counter-performance had the worker continued to work, pursuant to Article 538(1) of the Civil Act (민법). This is the consistent position taken by this Court (see Supreme Court Decisions 81Da626 rendered on December 22, 1981; 90Da8763 rendered on March 31, 1992; 92Da39860 rendered on December 8, 1992, among others).

Furthermore, whether there is attributable cause must be determined as of the time of dismissal, and thus, even if the Labor Relations Commission subsequently dismissed the worker's application for remedy for unfair labor practice after the dismissal, this does not mean that the employer is without attributable cause.

In addition, the wages that may be claimed for payment here mean wages as defined under Article 18 of the Labor Standards Act, and thus all wages that would be included in the total amount of wages forming the basis for calculating average wages under Article 19 of the same Act must be included, and such wages are not necessarily limited to ordinary wages.

Accordingly, it was proper for the court below to determine that the Plaintiff's failure to provide the same labor as before during the period of the standby order and dismissal was attributable to the Defendant, and, after finding, based on the evidence it cited, the Plaintiff's average monthly holiday work hours, night work hours, daytime overtime hours, and night overtime hours during the three months immediately preceding the standby order, to order payment by including the overtime allowance, holiday work allowance, daytime overtime allowance, and night overtime allowance as set forth in its holding within the scope of wages as counter-performance under Article 538(1) of the Civil Act. There is no error of misapprehension of legal principles or incomplete deliberation as alleged in the grounds of appeal. This ground of appeal is also without merit.

As to Ground No. 4

In general, where an employer's disadvantageous disposition against a worker, such as dismissal, is determined to be invalid, such fact alone cannot immediately mean that the dismissal or other disadvantageous disposition constitutes a tort. However, a worker who continuously provides labor under an employment contract is a person of dignity and value as a human being, and the worker's provision of labor is not merely significant as performance of the employment contract for the purpose of earning wages, but also has the aspect of realizing such personality through labor. Therefore, where an employer wrongfully dismisses or takes a disadvantageous disposition against a worker in violation of the mandatory prohibition against discriminatory treatment under Article 39 of the Trade Union Act, rendering such dismissal, etc., invalid, and where the abuse of the disciplinary authority is clearly unacceptable under sound social norms or common social standards—such as in a case where the reason asserted by the employer for the disadvantageous disposition is merely a pretextual reason, and in reality, the disadvantageous disposition, including dismissal, was carried out by deliberately invoking some pretextual ground for dismissal and employing the means of disciplinary action with the intent to exclude the worker from the workplace on the ground that the worker engaged in legitimate trade union activities—then the effect is not limited to the invalidation of the dismissal or other disadvantageous disposition, but such act constitutes the unlawful infliction of mental distress upon the other party and may thus constitute a tort against the worker (see Supreme Court Decision 92Da43586 rendered on October 12, 1993). In such a case, it cannot be said that this is merely a failure to perform the obligation to pay wages, and the fact that the worker receives payment of wage claims and delay damages thereon does not mean that the damage from the mental distress suffered by the worker due to the employer's wrongful dismissal, etc., is thereby completely healed. Moreover, insofar as the employer's disposition is recognized as an unfair labor practice, the employer's attributable cause is, in effect, presumed.

According to the evidence lawfully adopted by the court below, it can be recognized that both the standby order and the dismissal imposed by the Defendant on the Plaintiff were, in substance, disadvantageous dispositions carried out by employing the means of disciplinary action with the intent to exclude the Plaintiff from the Defendant's workplace out of aversion to the Plaintiff's legitimate trade union activities. This is clearly unacceptable under sound social norms or common social standards, and insofar as the above disadvantageous dispositions are recognized as unfair labor practices, the Defendant's attributable cause is presumed. Accordingly, it was proper for the court below, on the premise that the Defendant's standby order and dismissal of the Plaintiff constituted a tort, to find, based on empirical rules, that the Plaintiff must have suffered considerable mental distress as a result thereof, and, taking into account the various circumstances set forth in its holding, to order payment of consolation money. There is no error of misapprehension of legal principles, incomplete deliberation, insufficient reasoning, or omission of judgment as alleged in the grounds of appeal. This ground of appeal is also without merit.

Therefore, the appeal is dismissed, and the costs of the appeal are borne by the losing party. This judgment is rendered as stated in the Order by the unanimous opinion of the participating Justices.
