This case involved pharmacists at a university hospital who worked without using their annual and monthly paid leave (연·월차휴가) and sought compensation for the unused leave days, including a 50% overtime premium (가산임금). The Supreme Court ruled that the hospital must pay wages for the unused leave days, but reversed and remanded the part of the lower court's decision requiring the 50% overtime premium, since such leave is not classified as a legally mandated holiday under the Labor Standards Act. The Court also clarified the method for calculating hourly ordinary wages (통상임금) and the legal nature of overnight/day duty shifts (숙·일직근무) for hospital pharmacists.

Key takeaways
  • CaseIncident: Pharmacists at a university hospital worked without using their annual/monthly paid leave and demanded both leave-work compensation and a 50% overtime premium.
  • OutcomeResult: The Supreme Court ruled that the hospital must pay wages for the unused leave, but not the 50% overtime premium, since annual/monthly leave is not a legally designated holiday.
  • LessonLesson: If you don't use your annual/monthly leave, you can still claim your regular wage for those days, but not the 1.5x overtime rate — so it's generally more advantageous to actually take your leave.
Issues
  • Whether an employer must pay leave-work compensation when an employee works instead of using annual/monthly leave (연·월차휴가)
  • Whether the 50% overtime premium (가산임금) applies to compensation for unused leave
  • How to calculate the monthly standard working hours used as the basis for hourly ordinary wages (통상임금)
  • The legal characterization of overnight and day duty shifts (숙·일직근무) performed by university hospital pharmacists
Key reasoning

Under Korean labor law, an employee who works instead of using annual or monthly paid leave is entitled to claim wages equivalent to the unused leave days. However, Article 46 of the Labor Standards Act (근로기준법 제46조), which mandates a 50% premium for work performed on official holidays, does not include annual or monthly leave days within its definition of 'holidays.' Therefore, while the employer must pay the base wage for the unused leave, there is no legal obligation to pay the additional 50% overtime premium for those days. This reasoning distinguishes statutory holiday work from voluntary work performed in lieu of taking earned leave.

Summary of Decision (English, AI translation)

A. Where an employer and an employee have agreed on working hours within the limits of the standard working hours prescribed by the main text of Article 42(1), the main text of Article 43, or the main text of Article 55 of the Labor Standards Act (근로기준법), the agreed working hours, rather than the standard working hours under the main text of Article 42(1), etc. of the Labor Standards Act, must serve as the basis for calculating the ordinary hourly wage. Therefore, in calculating the ordinary hourly wage, it is legitimate to treat the weekly working hours (excluding hours corresponding to paid holidays) as 44 hours per week as stipulated in the service regulations of the hospital, which is the employer, to calculate the daily working hours by adding the number of hours corresponding to paid holidays thereto, to treat the number of prescribed working days per month as 365/12 days, and, on that basis, to calculate the number of prescribed monthly working hours as 225.9 hours.

B. Employees who continue to work without using their paid annual/monthly leave may additionally claim from the employer wages corresponding to the number of leave days not taken (annual/monthly leave-work allowance). The right to claim such wages does not extinguish merely because the employee has retired, nor can it be said that such a right does not arise merely because the employee did not exercise the right to claim annual/monthly leave before retiring. The employer's obligation to pay such annual/monthly leave allowance arises irrespective of whether the hospital's compensation regulations, which provide for monetary compensation for annual/monthly leave, are valid or invalid.

C. The premium wage payment system for overtime, night, and holiday work under Article 46 of the Labor Standards Act and the monthly and annual leave systems under Articles 47 and 48 of the same Act are systems serving different purposes, and in light of the fact that the wording of each provision distinguishes between "holidays" and "leave," it is reasonable to view that the "holidays" under Article 46 of the Labor Standards Act do not include the annual/monthly leave under Articles 47 and 48 of the same Act. Furthermore, according to Article 48(2) of the same Act, where the total number of leave days exceeds 20 days, the employer may pay ordinary wages for the days in excess thereof without granting paid leave. In light of this, it is reasonable, for the sake of balance, to view that where compensation must be paid for leave days of 20 days or fewer as well, it suffices to pay the ordinary wage additionally therefor. Accordingly, it must be held that the additional wage (allowance) under Article 46 of the Labor Standards Act cannot be included in the annual/monthly leave-work allowance.

D. In order to recognize that the content of a university hospital pharmacist's night-duty or day-duty work constitutes ordinary work, it is necessary to thoroughly examine matters such as: whether the work performed during night-duty or day-duty is completely free from the constraints of ordinary working hours, or whether the pattern of ordinary work continues as is; the frequency or duration of engagement in original duties such as dispensing medication for hospitalized or emergency patients during night-duty or day-duty; and whether sufficient sleeping hours are guaranteed during night-duty. Only where it is recognized, based on such examination, that the pattern of night-duty or day-duty work is, in its content and quality, equivalent to the pattern of ordinary work, should the night-duty or day-duty work be treated as ordinary work and the ordinary wage and the additional wage under Article 46 of the Labor Standards Act be paid therefor. Where the night-duty or day-duty work, viewed as a whole, constitutes intermittent work of low labor intensity that is merely of a standby nature, the additional wage under the said Act should be paid only for the hours during which the employee was actually engaged in duties such as dispensing during the night-duty or day-duty work.

[Defendant, Appellant] Seoul National University Hospital, Defendant's Attorney Dongyang General Law Firm, Attorneys in charge Choi Kwang-ryul and 3 others
[Judgment Below] Seoul High Court Judgment of April 4, 1990, 89Na50050

[Order]

The part of the judgment below concerning the Defendant's loss regarding the Plaintiffs' annual/monthly paid leave work allowance and overtime work allowance is reversed, and this part of the case is remanded to the Seoul High Court.
The Defendant's remaining appeal is dismissed.
The costs of the dismissed portion of the appeal shall be borne by the Defendant.

[Reasoning]

We examine the grounds of appeal submitted by the Defendant's litigation representative.

(1) The "prescribed daily working hours" or "prescribed weekly working hours" that serve as the basis for calculating ordinary wages refer to the hours agreed upon between the worker and the employer within the scope of the standard working hours prescribed by the main text of Article 42, Paragraph 1, the main text of Article 43, or the main text of Article 55 of the Labor Standards Act (근로기준법) (Article 31, Paragraph 3 of the Enforcement Decree of the Labor Standards Act (근로기준법시행령)). Therefore, where the employer and the worker have agreed upon working hours within the limits of the standard working hours, such agreed working hours shall take precedence over the standard working hours under the main text of Article 42, Paragraph 1, etc. of the Labor Standards Act as the basis for calculating the hourly ordinary wage. In the same vein, the court below, in calculating the Plaintiffs' hourly ordinary wage, determined the weekly working hours (excluding hours corresponding to the paid weekly holiday) to be 44 hours per week as prescribed by Article 12 of the Defendant Hospital's Service Regulations, added the 8 hours corresponding to the paid weekly holiday, calculated the daily working hours accordingly, treated the prescribed number of working days per month as 365/12 days, and on this basis calculated the prescribed monthly working hours as 225.9 hours; this measure is justified, and there is no error of misunderstanding the legal principles concerning the calculation of hourly ordinary wages. The Supreme Court's Judgments cited by the argument, rendered on October 10, 1978, 78Da1372, and on December 24, 1985, 84Daka254, concerned cases where there was no agreement between the employer and worker on working hours meeting the requirements of Article 31, Paragraph 3 of the Enforcement Decree of the Labor Standards Act, such that the former Labor Standards Act, Article 42, Paragraph 1 (before amendment by Act No. 4099 of March 29, 1989) had to be applied, or cases where labor and management agreed that the basic daily working hours would be 8 hours, in which case the prescribed monthly working hours forming the basis for calculating the hourly ordinary wage would be 240 hours (8 hours x 30 days); these cases differ in their facts from the present case and are therefore not appropriately invoked here. Moreover, the fact that the court below treated the number of days in a month not as 30 days but as 365/12 days cannot be said to constitute an error. This argument is without merit.

(2) Where the Plaintiffs continued to work without using their annual/monthly paid leave, the Plaintiffs may claim additional wages from the Defendant, their employer, corresponding to the number of leave days (annual/monthly leave work allowance), and the right to claim payment of such wages is not extinguished merely because the Plaintiffs have retired; nor can it be said that such right does not arise merely because the Plaintiffs did not exercise their right to claim annual/monthly leave before retiring (see Supreme Court Judgment of December 28, 1971, 71Da1713). Furthermore, the Defendant's obligation to pay such annual/monthly leave work allowance arises irrespective of whether Article 28 of the Defendant Hospital's Remuneration Regulations, which provides for monetary compensation for annual/monthly leave, is void. Therefore, this argument is without merit.

(3) According to the reasoning of the judgment below, the court below, having found that the Plaintiffs came to work and performed their duties without using each of the annual/monthly leave days as determined in the judgment below, held that Article 46 of the Labor Standards Act, which provides that for overtime work, night work, and holiday work, an amount not less than 50/100 of the ordinary wage must be paid in addition, is a system designed to pay additional wages for work exceeding the standards of the 8-hour workday system, the weekly working system, the weekly holiday system, and the annual/monthly leave system, etc., which are intended to guarantee workers' health and rest; and that, since there is no reasonable basis for distinguishing between working on annual/monthly leave days and working on a weekly holiday, the "holiday work" under Article 46 of the said Act must be interpreted to include holidays arising from annual/monthly leave under Articles 47 and 48 of the Act. On this basis, the court below held that the Defendant was obligated to pay the Plaintiffs, as annual/monthly leave work allowance, an amount calculated by multiplying the ordinary wage corresponding to the annual/monthly leave days by the premium rate (1.5). However, the institutional purpose of the premium wage payment system under Article 46 of the Labor Standards Act is to provide economic compensation corresponding to the fact that overtime, night work, and holiday work bring greater fatigue and tension to workers than work performed within standard working hours, thereby restricting the free time in life that workers may enjoy; whereas the purpose of the monthly and annual paid leave system under Articles 47 and 48 of the same Act, unlike overtime work or the paid weekly holiday system, lies in promoting the improvement of workers' cultural life through mental and physical rest, and these are thus different systems. In light of the fact that the wording of each provision distinguishes between "holiday" and "leave," it is appropriate to interpret that the "holiday" under Article 46 of the Labor Standards Act does not include the annual/monthly leave under Articles 47 and 48 of the same Act. Furthermore, under Article 48, Paragraph 2 of the same Act, where the total number of leave days exceeds 20 days, the employer may pay the ordinary wage for the days in excess without granting paid leave; therefore, it would be balanced and reasonable to hold that, for leave days of 20 days or fewer as well, where compensation is required, it suffices to pay the ordinary wage in addition. Accordingly, it must be held that there is no obligation to pay the additional wage (allowance) under Article 46 of the Labor Standards Act with respect to the Plaintiffs' annual/monthly leave work allowance. Therefore, the judgment below contains an error of misunderstanding the legal principles concerning the annual/monthly leave work allowance and the additional wage under Article 46 of the Labor Standards Act, which affected the judgment, and the argument pointing this out is well-founded.

(4) According to the reasoning of the judgment below, the court below found, based on the Defendant Hospital's Service Regulations, that employees' ordinary working hours were from 09:00 to 18:00, excluding the rest period from 12:00 to 13:00, in principle 8 hours per day, with Saturdays being 4 hours from 09:00 to 13:00, and Sundays being paid holidays; and that it was undisputed between the parties that the Plaintiffs, who were female workers employed as pharmacists at the Defendant Hospital, in addition to the above agreed working hours, worked, as ordered by the Defendant Hospital, on the number of occasions determined in the judgment below, 15 hours each from 18:00 to 09:00 the following day under night duty orders, and 8 hours each from 09:00 to 18:00 on holidays under holiday work orders and holiday day duty orders. The court below, based on the evidence cited, found that the content of the Plaintiffs' duties during such night/day duty work was not simple intermittent work such as guarding or monitoring, but was the same content of work as ordinary weekday work, such as dispensing for medication administration; and on the premise that such night/day duty work of the Plaintiffs constituted overtime work or holiday work under Article 46 of the Labor Standards Act, held that the Defendant was obligated to pay the Plaintiffs, as overtime work allowance or holiday work allowance, an amount calculated by multiplying the ordinary wage corresponding to each night/day duty working hour by the premium rate of 1.5. However, in order to recognize that the content of the Plaintiffs' night/day duty work constitutes ordinary work, it is necessary to sufficiently examine matters such as whether the work during night/day duty was completely free from the constraints of ordinary working hours, or whether the pattern of ordinary work continued as is; the frequency or duration of engagement in the original duties, such as dispensing for medication administration for hospitalized or emergency patients, during night/day duty work; and whether sufficient sleep time was guaranteed during night duty work. Only when it is found that the pattern of the Plaintiffs' night/day duty work is, in its content and quality, equivalent to the pattern of ordinary work, should the night/day duty work be regarded as ordinary work and the ordinary wage and the additional wage under Article 46 of the Labor Standards Act be paid therefor (in this case as well, if a fixed sleep period is granted, such sleep period must be excluded from working hours). Where the night/day duty work, viewed as a whole, constitutes low-intensity, standby-type intermittent work, the additional wage under the said Act should be paid only for the time during which the Plaintiffs actually engaged in duties such as dispensing during their night/day duty work.

However, according to the record, the only evidence concerning the pattern of the Plaintiffs' night/day duty work is the testimony of a witness, Non-party, in the first instance, the content of which is: "The Plaintiffs, all of whom are female pharmacists, did not engage in monitoring or intermittent duties such as guarding during night/day duty work, but performed their original duties, such as dispensing for medication administration." This testimony is ambiguous as to the specific content of the quantity and quality of the pattern of night/day duty work. Since the Defendant asserted that the content of the Plaintiffs' night/day duty work was standby-type work of low labor intensity, the court below should have further clarified and examined the various circumstances noted above necessary to determine the pattern of the Plaintiffs' night/day duty work, and should have determined whether the Plaintiffs' night/day duty work constituted intermittent standby-type work to which Article 46 of the Labor Standards Act does not apply, or whether, in its content and quality, it constituted ordinary work. Nevertheless, without taking such measures, the court below recognized the entirety of the Plaintiffs' night/day duty working hours as ordinary work based solely on the abstract and ambiguous testimony of the aforesaid witness; in this respect, the court below committed an error of failing to exhaust its examination by neglecting to exercise its right of clarification, which affected the judgment, and the argument pointing this out is well-founded.

Therefore, the part of the judgment below concerning the Defendant's loss regarding the annual/monthly leave allowance and the part concerning the Defendant's loss regarding the Plaintiffs' overtime work allowance are reversed and remanded to the court below, and the Defendant's remaining appeal is dismissed, with the costs of the dismissed portion of the appeal to be borne by the losing party; the opinions of the Justices involved being unanimous, it is so ordered as stated in the Order.
