Employees of Seoul National University Hospital filed a claim demanding proper calculation of 'ordinary wages' (통상임금) and payment of various allowances, including compensation for unused annual/monthly leave (연월차휴가). The Supreme Court (대법원) established key legal principles on wage calculation, ruling that family allowances and tuition subsidies should be excluded from ordinary wages, while working hours corresponding to paid holidays must be included when calculating hourly ordinary wages. The Court also held that employees who retire without using their annual/monthly leave are entitled to compensation for the unused days, and remanded certain issues, including leave compensation, back to the lower court for further review.

Key takeaways
  • CaseIncident: Employees of Seoul National University Hospital demanded proper calculation of ordinary wages and compensation for unused annual/monthly leave.
  • OutcomeResult: The Court excluded family allowances and tuition subsidies from ordinary wages but confirmed that unused leave must be compensated upon retirement.
  • LessonLesson: Only fixed wages tied to the quantity and quality of work count as ordinary wages, and employers must always pay out unused annual/monthly leave when an employee retires.
Issues
  • Scope of ordinary wages (통상임금): whether family allowances and tuition subsidies should be included
  • Method for calculating monthly standard working hours when determining hourly ordinary wages
  • Employer's obligation to pay compensation for unused annual/monthly leave (연월차휴가) upon retirement
  • Whether excess work within legal working hour limits constitutes overtime work
  • Employer's obligation to pay allowances when menstrual leave (생리휴가) was not formally requested
  • Scope of recognized overtime work under a flexible working hour system
Key reasoning

Ordinary wages (통상임금) refer to fixed, regular, and uniformly paid wages directly tied to the quantity and quality of work performed. Since family allowances and tuition subsidies are not directly linked to work performance in this way, they must be excluded from the calculation of ordinary wages. When calculating hourly ordinary wages, the monthly standard working hours must include hours corresponding to paid holidays, not just actual working hours. Additionally, if an employee retires without using earned annual or monthly leave, the employer must compensate them for the unused days as regular wages, although this compensation does not qualify for overtime premium rates (가산임금).

Summary of Decision (English, AI translation)

가. "Ordinary wages" under Article 19 Paragraph 2 of the Labor Standards Act (근로기준법) and Article 31 Paragraph 1 of the Enforcement Decree of the Labor Standards Act (근로기준법시행령) mean fixed wages determined to be paid regularly and uniformly during one wage calculation period as compensation for work related to the quantity and quality of labor, regardless of the actual number of working days or the amount received; therefore, family allowances or tuition subsidies that are paid merely as a matter of grace, irregularly, or that are paid only to some workers based on factors unrelated to the quantity and quality of labor must be excluded from the calculation of ordinary wages.

나. Where wages are paid to a worker on a monthly basis, the monthly ordinary wage must be deemed to include wages for paid holidays under Article 45 of the Labor Standards Act; therefore, in calculating the hourly ordinary wage by dividing the monthly ordinary wage by the prescribed monthly working hours, the working hours corresponding to monthly paid holidays must also be included in the prescribed monthly working hours.

다. Even if the employer's remuneration regulations provide that "the hourly wage rate shall be calculated as 1/184 of the monthly wage," this does not itself prescribe the prescribed monthly working hours, but merely sets forth one standard for calculating various allowances under the said remuneration regulations, and accordingly does not apply when calculating ordinary wages, overtime allowances, or annual/monthly leave work allowances, etc. under the Labor Standards Act.

라. Even if, pursuant to the employer's service regulations, the working hours on weekdays excluding Saturdays are shortened by one hour during the winter season from November 1 to March 31 of the following year, this is merely a convenience measure taking into account policy factors such as energy conservation and seasonal factors, and is not intended to increase workers' hourly ordinary wages; therefore, such circumstance cannot be taken into account in calculating the prescribed monthly working hours that form the basis for calculating the hourly ordinary wage.

마. With respect to menstrual leave under Article 59 of the former Labor Standards Act (before its amendment by Act No. 4099 of March 29, 1989), an employer must grant one day of menstrual leave per month when a female worker requests it pursuant to the above provision, but it cannot be deemed unlawful if the employer does not grant leave in the absence of such a request, and in such a case, additional wages (allowances) need not necessarily or automatically be paid.

바. Work performed in excess of the working hours agreed upon between the employer and the worker but within the standard working hours prescribed under Articles 42, 43, and 55 of the Labor Standards Act (so-called overtime work within the statutory limit) does not constitute overtime work under Article 46 of the Labor Standards Act.

사. Since the prescribed daily working hours forming the basis for calculating ordinary wages mean the hours agreed upon between the worker and the employer within the scope of the standard working hours under the main text of Article 42 Paragraph 1, the main text of Article 43, or the main text of Article 55 of the Labor Standards Act (Article 31 Paragraph 3 of the Enforcement Decree of the Labor Standards Act), where the employer and the worker have agreed on working hours within the limits of the standard working hours, the agreed working hours must take precedence over the standard working hours under the main text of Article 42 Paragraph 1, etc. of the Labor Standards Act, and must serve as the basis for calculating the hourly ordinary wage.

아. Workers who continued to work without using their annual/monthly paid leave may additionally claim from the employer wages corresponding to the number of leave days (annual/monthly leave work allowance), and the right to claim such wages is not extinguished merely because the worker has retired; nor can it be said that such right fails to arise merely because the worker did not exercise the right to claim annual/monthly leave before retirement. Moreover, the employer's obligation to pay such annual/monthly leave work allowance arises regardless of whether the employer's remuneration regulations providing for monetary compensation for annual/monthly leave are void.

자. The premium wage payment system under Article 46 of the Labor Standards Act and the annual/monthly leave system under Articles 47 and 48 of the same Act serve different purposes, and in light of the fact that the wording of each provision distinguishes between "holidays" and "leave," it is reasonable to conclude that the "holidays" under Article 46 of the same Act do not include the annual/monthly leave under Articles 47 and 48 of the same Act. Furthermore, since under Article 48 Paragraph 2 of the same Act, where the total number of leave days exceeds 20 days, ordinary wages may be paid for the excess days in lieu of granting paid leave, it is reasonable, for the sake of balance, to conclude that where compensation must be paid for leave days of 20 days or fewer, it suffices to pay the ordinary wage in addition; therefore, it must be held that the additional wage (allowance) under Article 46 of the same Act cannot be included in the annual/monthly leave work allowance.

차. In the case of a worker subject to the so-called modified working hour system by agreement recognized under Article 42 Paragraph 2 of the former Labor Standards Act (before its deletion by Act No. 3965 of November 28, 1987), the working hours lawfully agreed upon between the parties must themselves be regarded as the standard working hours; therefore, even where the working hours on a specific day or in a specific week exceed 8 hours or 48 hours, this is merely compensated for by reduced work on another specific day or specific week, and it is difficult to regard the excess hours as overtime work subject to payment of the overtime allowance under Article 46 of the Labor Standards Act.

[Judgment Below] Seoul High Court Decision 89Na49241 rendered on April 11, 1990

[Order]

The part of the judgment below concerning the Plaintiffs' annual/monthly paid leave allowance and overtime work allowance is reversed, and this part of the case is remanded to the Seoul High Court.

All remaining appeals by the Plaintiffs and the Defendant are dismissed.

The costs of the dismissed portions of the appeals shall be borne by each respective party.

[Reasoning]

1. As to the grounds of appeal by the Plaintiffs' attorneys

A. As to Ground 1

(1) The "ordinary wage" prescribed in Article 19(2) of the Labor Standards Act (근로기준법) and Article 31(1) of its Enforcement Decree refers to the hourly wage amount, daily wage amount, weekly wage amount, monthly wage amount, or piece-rate amount that is determined to be paid to a worker regularly and uniformly for the prescribed work or total work. This constitutes remuneration for work related to the quantity and quality of labor, and means a fixed wage that is determined to be paid regularly and uniformly during one wage calculation period, regardless of the actual number of working days or the amount actually received (see this Court's Decisions 78Da1372 rendered on October 10, 1978 and 90Daka12493 rendered on December 26, 1990). Accordingly, payments that are merely gratuitous or irregular, or that are paid to only some workers based on factors unrelated to the quantity and quality of labor, must be excluded from the calculation of ordinary wages.

(2) The court below's measure, in the same vein, of excluding from the scope of ordinary wages the family allowance paid under Article 35-2 of the Defendant Hospital's Remuneration Regulations to regular employees with dependents, and the tuition subsidy paid under Article 5 of the Defendant Hospital's Welfare Management Bylaws to employees' children enrolled in or admitted to middle or high school, is justified, and there is no error of misapprehending the legal principles concerning the scope of ordinary wages therein.

This ground of appeal is without merit.

B. As to Ground 2

(1) Where wages are paid to a worker on a monthly basis, the monthly ordinary wage must be deemed to include wages for paid holidays as prescribed in Article 45 of the Labor Standards Act. Therefore, in calculating the hourly ordinary wage by dividing the monthly ordinary wage by the number of prescribed monthly working hours, the number of working hours corresponding to monthly paid holidays must also be included in the number of prescribed monthly working hours (see this Court's Decisions 84Daka254 rendered on December 24, 1985 and 90Daka12493 rendered on December 26, 1990).

Accordingly, the court below's measure of calculating the number of prescribed monthly working hours based on the 44-hour weekly working hours of employees under Article 12 of the Defendant Hospital's Service Regulations and the working hours corresponding to paid holidays is justified.

(2) Furthermore, even if, as argued in the grounds of appeal, Article 6(5) of the Defendant Hospital's Remuneration Regulations provides that "the hourly wage rate shall be calculated as 1/184 of the monthly wage," this provision does not itself prescribe the number of prescribed monthly working hours, but merely presents one standard for calculating various allowances under the Defendant Hospital's Remuneration Regulations. Therefore, it does not apply when calculating ordinary wages, overtime work allowances, or annual/monthly leave work allowances under the Labor Standards Act. Moreover, even though Article 14(1) proviso of the Defendant Hospital's Service Regulations shortens the working hours by one hour on weekdays excluding Saturdays during the winter season from November 1 to March 31 of the following year, this is merely a convenience measure taking into account policy factors such as energy conservation and seasonal factors, and is not intended to increase workers' hourly ordinary wages. Accordingly, this circumstance cannot be considered in calculating the number of prescribed monthly working hours that forms the basis for calculating the hourly ordinary wage.

Therefore, the judgment below does not contain an error of misapprehending the legal principles concerning the number of prescribed monthly working hours as the basis for calculating hourly ordinary wages under Article 31(2)(4) of the Enforcement Decree of the Labor Standards Act, nor does it violate Article 2 of the Labor Standards Act by arbitrarily interpreting the Defendant Hospital's Service Regulations unfavorably to the workers by analogy. This ground of appeal is without merit.

C. As to Ground 3

With respect to menstrual leave under Article 59 of the former Labor Standards Act (before amendment by Act No. 4099 of March 29, 1989), it is the view of this Court that, although an employer must grant one day of menstrual leave per month when a female worker requests it pursuant to that provision, it cannot be deemed unlawful if the employer does not grant such leave absent a request, and in such a case, the employer is not necessarily or automatically obligated to pay premium wages (allowance) (see this Court's Decisions 86Daka2567 rendered on February 28, 1989 and 90Daka12493 rendered on December 26, 1990). Accordingly, the court below's measure, in the same vein, of rejecting some of the Plaintiffs' claims for menstrual leave allowance in this case is correct, and there is no error of misapprehending the legal principles concerning menstrual leave therein. This ground of appeal is without merit.

D. As to Ground 4

(1) According to the reasoning of the judgment below, the court below adopted as is the judgment of the court of first instance, which rejected the Plaintiffs' claim for overtime work allowance under Article 46 of the Labor Standards Act on the ground that the Plaintiffs worked 8 hours on Saturdays four times per month, exceeding the ordinary Saturday working hours of 4 hours for workers belonging to the Defendant Hospital, thereby performing 16 hours of overtime work per month, on the reasoning that work exceeding the agreed working hours between the employer and worker within the scope of the standard working hours prescribed in Articles 42, 43, and 55 of the Act (so-called "excess work within the statutory limit") does not constitute overtime work under Article 46 of the Act. The court below's determination as above is correct, and it cannot be said that there is an error of misapprehending the legal principles concerning overtime work allowance under Article 46 of the Act therein.

(2) However, according to the record, the Plaintiffs' attorney stated at the 12th hearing date of the first instance that this claim for overtime work allowance was a claim for overtime work allowance under the Labor Standards Act, but in the brief dated February 15, 1990, submitted and stated at the first hearing date before the court below, argued that, in light of the Defendant Hospital's Service Regulations and the Guidelines on Overtime, Holiday, and Night Work, the Defendant was obligated to pay overtime work allowance under the Defendant Hospital's Remuneration Regulations for work performed in excess of the working hours agreed upon between labor and management, and that even if premium wages were not to be paid for work exceeding the agreed working hours, at least the ordinary wage should be paid for that portion. Accordingly, it must be found that the Plaintiffs are claiming, with respect to the 4 hours of work out of the 8 hours worked on Saturdays: first, overtime work allowance under the Labor Standards Act; second, overtime work allowance under the agreement between labor and management; and third, as an alternative claim, ordinary wages. Therefore, the court below should have examined and determined each of these claims. In addition to determining the Plaintiffs' first claim, the court below should have examined whether the Plaintiffs in fact performed work exceeding the working hours agreed upon between labor and management (this is because Article 12 of the Defendant Hospital's Service Regulations provides that "the daily working hours of employees shall in principle be 8 hours, provided that Saturdays shall be 4 hours; provided, however, that where adjustment is necessary due to seasonal changes, the nature of duties, or special circumstances, such adjustment may be made within the scope prescribed by the Labor Standards Act," and Article 13 of the same Regulations provides that the actual daily working hours of shift workers on a three-shift system shall be 8 hours. Therefore, it is difficult to conclude that, simply because the Plaintiffs, who are three-shift workers, worked 8 hours on Saturdays, 4 hours thereof constitute work exceeding the agreed working hours; rather, only the portion of the weekly working hours, including Saturday work, that exceeds 44 hours should be deemed work exceeding the agreed working hours). If there was work exceeding the agreed working hours, the court below should have determined whether the Defendant was obligated to pay overtime work allowance or ordinary wages under the Defendant Hospital's Remuneration Regulations for such work. Nevertheless, the judgment below, having failed to reach this determination, contains an error of insufficient deliberation or omission of judgment in this regard. Therefore, the ground of appeal pointing this out has merit.

2. As to the grounds of appeal by the Defendant's attorney

A. As to Ground 1

(1) The prescribed daily working hours, which form the basis for calculating ordinary wages, refer to the hours agreed upon between the worker and the employer within the scope of the standard working hours prescribed in the main text of Article 42(1), the main text of Article 43, or the main text of Article 55 of the Labor Standards Act (Article 31(3) of the Enforcement Decree of the Labor Standards Act). Therefore, where the employer and worker have agreed on working hours within the limits of the standard working hours, such agreed working hours must take precedence over the standard working hours under the main text of Article 42(1), etc. of the Labor Standards Act, as the basis for calculating the hourly ordinary wage.

The court below's measure, in this vein, of calculating the Plaintiffs' hourly ordinary wage by treating the weekly working hours (excluding hours corresponding to paid holidays) as the 44 hours prescribed in Article 12 of the Defendant Hospital's Service Regulations, adding thereto the hours corresponding to paid holidays to calculate daily working hours, and then, treating the prescribed monthly working days as 365/12 days, calculating the prescribed monthly working hours as 225.9 hours on that basis, is justified, and there is no error of misapprehending the legal principles concerning the calculation of hourly ordinary wages therein.

(2) This Court's Decisions 78Da1372 rendered on October 10, 1978, and 84Daka254 rendered on December 24, 1985, cited in the argument, concern cases where there was no agreement on working hours meeting the requirements of Article 31(3) of the Enforcement Decree of the Labor Standards Act between the employer and worker, such that the former Article 42(1) of the Labor Standards Act (before amendment by Act No. 4099 of March 29, 1989) had to be applied, or cases holding that where labor and management agreed that the basic daily working hours would be 8 hours, the prescribed monthly working hours forming the basis for calculating hourly ordinary wages would be 240 hours (8 hours × 30 days). These cases differ in facts from the present case and are not appropriate to be invoked herein.

Moreover, it cannot be said that the court below erred by treating the number of days in a month as 365/12 rather than 30. This ground of appeal is without merit.

B. As to Ground 2

(1) It is the view of this Court that, where the Plaintiffs continued to work without using their annual/monthly paid leave, the Plaintiffs may claim from the Defendant, as their employer, additional wages (annual/monthly leave work allowance) corresponding to the number of leave days, and that this right to claim such wages is not extinguished by the Plaintiffs' retirement, nor can it be said that such right does not arise merely because the Plaintiffs did not exercise their right to annual/monthly leave before retirement (see this Court's Decisions 71Da1713 rendered on December 28, 1971 and 90Daka12493 rendered on December 26, 1990).

Furthermore, the Defendant's obligation to pay such annual/monthly leave work allowance arises regardless of whether Article 28 of the Defendant Hospital's Remuneration Regulations, which provides for monetary compensation for annual/monthly leave, is invalid. Therefore, this ground of appeal is without merit.

(2) According to the reasoning of the judgment below, the court below, having found the fact that the Plaintiffs worked without using their respective annual/monthly leave days as determined in the judgment below, held that Article 46 of the Labor Standards Act, which requires payment of an amount not less than 50/100 in addition to the ordinary wage for overtime work, night work, and holiday work, is a system designed to require payment of premium wages for work exceeding the standards of the 8-hour workday system, the weekly work system, the weekly holiday system, and the annual/monthly leave system, etc., which are established to guarantee workers' health and rest, and that, since there is no reasonable basis for distinguishing between working on annual/monthly leave days and working on weekly holidays, the "holiday work" under Article 46 of the Act must be deemed to include holidays arising from annual/monthly leave under Articles 47 and 48 of the Act. On this basis, the court below held that the Defendant is obligated to pay the Plaintiffs, as annual/monthly leave work allowance, an amount calculated by multiplying the ordinary wage corresponding to the annual/monthly leave days by the premium rate (1.5).

However, the institutional purpose of the premium wage payment system prescribed in Article 46 of the Labor Standards Act is to provide corresponding economic compensation because overtime, night, and holiday work causes greater fatigue and tension to workers than work performed within the standard working hours, and restricts the free time in life that workers may enjoy. In contrast, the annual/monthly leave system under Articles 47 and 48 of the Act, unlike overtime work or the paid weekly holiday system, has its purpose in promoting the improvement of workers' cultural life through mental and physical rest, and is thus a different system. Furthermore, in light of the fact that the language of each statutory provision distinguishes between "holiday" and "leave," it is appropriate to view that "holiday" under Article 46 of the Act does not include annual/monthly leave under Articles 47 and 48 of the Act. In addition, under Article 48(2) of the Act, where the total number of leave days exceeds 20 days, the employer may pay the ordinary wage for the days in excess without granting paid leave. Therefore, for balance, it is reasonable to view that, even where compensation must be paid for leave days of 20 days or less, it suffices to pay the ordinary wage additionally, and accordingly, the premium wage (allowance) under Article 46 of the Act cannot be included in the Plaintiffs' annual/monthly leave work allowance.

Therefore, the judgment below, which took a different view, contains an error of misapprehending the legal principles concerning annual/monthly leave work allowance and the premium wage under Article 46 of the Act, and the ground of appeal pointing this out has merit.

C. As to Ground 3

(1) According to the reasoning of the judgment below, the court below adopted as is the judgment of the court of first instance, which found, as an undisputed fact between the parties, that from November 1984 to October 1987, the Plaintiffs worked in three shifts without distinction between weekdays and Saturdays—day shift from 07:30 to 15:30 (8 hours), evening shift from 15:30 to 22:30 (7 hours), and night shift from 22:30 to 07:30 the following day (9 hours)—and worked night shifts 7 times per month, and which held that the 1 hour (7 hours per month) of the 9-hour night shift exceeding the 8-hour standard daily working hours under the Labor Standards Act constitutes overtime work under Article 46 of the Act, for which the Defendant is obligated to pay overtime work allowance under that provision.

(2) However, Article 42(1) of the Labor Standards Act (before amendment by Act No. 3965 of November 28, 1987) provided that "working hours shall be based on 8 hours per day and 48 hours per week, excluding rest periods," while Article 42(2) of the same Act provided that "an employer may, where there is an agreement between the parties, have a worker work in excess of 8 hours on a specific day or 48 hours in a specific week, within the scope in which the average weekly working hours over 4 weeks do not exceed 48 hours," thereby recognizing the so-called agreed variable working hours system. The recognition of the agreed variable working hours system was established for the purpose of achieving reasonableness between labor and management by operating the 8-hour daily, 48-hour weekly system with a certain degree of flexibility, while maintaining the 8-hour daily, 48-hour weekly system, since fixed operation of the 8-hour daily, 48-hour weekly system could, depending on the nature of the work, impose excessive burden or inconvenience on one or both parties in many cases. Therefore, for workers subject to such a variable working hours system, the working hours lawfully agreed upon between the parties themselves must be deemed to constitute the standard working hours. Accordingly, even if the working hours on a specific day or in a specific week exceed 8 hours or 48 hours, this is merely compensated by reduced work on another specific day or specific week, and it is difficult to view the excess hours as overtime work subject to payment of overtime work allowance under Article 46 of the Act.

This is because agreed variable work is merely a variation of working hours within the scope of the standard working hours and thus differs from extended work (overtime), and if premium wages were required to be paid for such work, there would be no difference in private law effect from unlawful variable work, making it difficult to dispel the concern that this would encourage unlawful variable work.

(3) Accordingly, even if the Plaintiffs worked 9 hours per day during night shifts under the agreed variable working hours system, this is merely variable work conforming to Article 42(2) of the former Labor Standards Act and cannot be regarded as overtime work under Article 46 of the Labor Standards Act. Nevertheless, the court below, having recognized this as overtime work under that provision and ordered payment of overtime work allowance under that provision, erred by misapprehending the legal principles concerning the agreed variable working hours system or overtime work allowance under the Labor Standards Act, and the ground of appeal pointing this out has merit.

3. Therefore, the part of the judgment below concerning the Plaintiffs' overtime work allowance and the part concerning annual/monthly leave work allowance are reversed, and this part of the case is remanded to the Seoul High Court. All remaining appeals are dismissed, and the costs of the dismissed portions of the appeals shall be borne by each respective party. This judgment is rendered by the unanimous opinion of the participating Justices, as set forth in the Order.
