After a company's first disciplinary dismissal (징계해고) was ruled invalid by a court, the company voluntarily rescinded that dismissal and issued a second disciplinary dismissal, adding a new ground: the employee's participation in an illegal strike. The Supreme Court held that an employer may voluntarily cancel a disciplinary action and issue a new one, and that an employee's participation in an illegal strike while contesting the validity of their dismissal can itself serve as a valid ground for discipline.

Key takeaways
  • CaseAfter its first dismissal was ruled invalid, the company rescinded that dismissal and issued a second dismissal, adding the employee's participation in an illegal strike as a new ground.
  • OutcomeThe Supreme Court ruled that an employer may voluntarily rescind a disciplinary action and issue a new one, and that participation in an illegal strike—even while contesting a dismissal—can constitute valid grounds for discipline.
  • LessonEmployees should avoid engaging in illegal strikes or other misconduct even while disputing their dismissal, and employers should understand they may rescind a flawed disciplinary action and reissue a valid one.
Issues
  • Whether an employer may voluntarily rescind its own disciplinary action and subsequently issue a new disciplinary action
  • Whether an employee's participation in an illegal strike while contesting the validity of their dismissal can constitute a valid ground for discipline
  • Whether issuing a new disciplinary dismissal after rescinding the original one violates the principle against double jeopardy or the principle of good faith
Key reasoning

When an employer recognizes defects in the disciplinary procedure or errors in the grounds for discipline, it may voluntarily rescind the original disciplinary action and issue a new, legally proper one. Even while an employee is contesting the validity of their dismissal in court, if that employee participates in an illegal labor strike, they remain responsible for that conduct. Therefore, if the employee is later reinstated, such participation in the illegal strike can be used as a legitimate ground for a subsequent disciplinary action. Issuing a new disciplinary dismissal based on this additional ground does not violate the principle against double jeopardy (일사부재리) or the principle of good faith (신의칙), since it addresses a separate act committed after the original dismissal.

Summary of Decision (English, AI translation)

[1] The principle of party presentation (辯論主義) applies only to main facts and does not apply to indirect facts. Since matters such as the date and place of the convening of the disciplinary committee are merely indirect facts, recognizing them without any assertion by the parties does not constitute a violation of the principle of party presentation.

[2] A disciplinary action taken by an employer against an employee is a punishment imposed as a sanction for the employee's violation of workplace order, and since the disciplinary action may be revoked even through the employer's own reexamination procedure, where the employer itself acknowledges that there was a defect in the disciplinary procedure, an error in the recognition of grounds for discipline, or unfairness in the disciplinary measure imposed, the employer may revoke the disciplinary action on its own initiative without waiting for a remedial order from the Labor Relations Commission (노동위원회) or a judgment confirming invalidity from the court, and furthermore, it is also possible for the employer to newly impose a lawful disciplinary action.

[3] Once a disciplinary dismissal is revoked, it is to be regarded, retroactively, as if the employee had not been dismissed, in the same manner as if a judgment confirming the invalidity of the dismissal had become final. Therefore, imposing a new disciplinary action thereafter based on the same grounds or by adding new grounds cannot be deemed to violate the principle of double jeopardy (一事不再理) or the principle of good faith, and revoking a disciplinary action after a judgment confirming the invalidity of the disciplinary action has been rendered cannot be regarded as circumventing the court's judgment.

[4]
The proviso of Article 3, Subparagraph 4 of the Trade Union Act (勞動組合法) is a provision aimed at protecting the establishment and continued existence of trade unions and preventing the activities of trade unions from being obstructed by the employer's unjust exercise of personnel authority, and it prescribes the qualifications for becoming a member of a trade union. Accordingly, this provision applies only in relation to the status as a member of a trade union, and cannot be extended to apply generally to the effect of an individual employment contract between an employee and an employer.

[5] An employee who, within a reasonable period after being dismissed, is contesting the validity of the dismissal through legal proceedings does not fall under the category of a "third party" who is prohibited from intervening in industrial action, and therefore retains the status of an employee or union member who may participate in industrial action. To that extent, even a dismissed employee is obligated to comply with the company's regulations or statutory provisions relating to industrial action, and therefore, if such an employee participates in an illegal industrial action, that employee cannot avoid liability therefor. Accordingly, conduct involving participation in an illegal industrial action may constitute grounds for disciplinary action if the dismissal is later found to be invalid and the employee's status is restored.

[6] Where the rules of employment or other disciplinary regulations do not provide for procedures such as affording the person accused of a disciplinary offense an opportunity to appear and make statements, the validity of a disciplinary action is not affected even if such procedures were not followed in imposing the disciplinary action.

[Order]

The appeal is dismissed. The costs of the appeal are to be borne by the Plaintiff.

[Reasoning]

The grounds of appeal are examined.

1. As to Ground 1 (Violation of the Rules of Evidence, Insufficient Deliberation, and Violation of the Principle of Party Presentation)

According to the reasoning of the judgment below, the court below, upon comprehensive consideration of the evidence cited therein, found the following facts: the Plaintiff, who was working as an assistant sawmill worker for Company Borneo Furniture Co., Ltd. (hereinafter referred to as the "Defendant Company"), a company undergoing reorganization, harbored dissatisfaction with the result of the union's own accounting audit announced on January 13, 1989, and on January 14 and 16 of the same month left his workplace for about 30 minutes each time to post notices demanding an explanation, resulting in friction with employees who tried to stop him; on this ground, he was disciplinarily dismissed on January 21, 1989 (hereinafter referred to as the "First Dismissal"); the Plaintiff filed a lawsuit against the Defendant Company on March 18, 1989, seeking confirmation of the invalidity of the dismissal; thereafter, on August 2, 1990, a judgment in favor of the Plaintiff was rendered in that lawsuit, and the Defendant Company, on the 20th of the same month, rescinded the First Dismissal, and on the 22nd of the same month, based not only on the grounds for the First Dismissal but also on the ground that the Plaintiff had, prior thereto, conspired to bring about an illegal strike and disturbance that occurred within the company from March 22, 1989 to April 4 of the same year, incited workers, actively and leadingly participated in the said strike, damaged company property, and obstructed business, thereby violating the collective agreement or the rules of employment, newly dismissed the Plaintiff on disciplinary grounds following a resolution of the disciplinary committee (hereinafter referred to as "the instant dismissal"). Upon examining this against the record, the fact-finding of the court below is deemed justified and acceptable, and it cannot be said that there was any illegality therein, such as insufficient deliberation or violation of the rules of evidence resulting in a mistaken finding of facts, as argued in the grounds of appeal.

Furthermore, the principle of party presentation applies only to material facts and does not apply to indirect facts (see, e.g., this Court's Decision 92Da23315, 23322, dated April 13, 1993); since the date and place of the disciplinary committee meeting are merely indirect facts, it cannot be said that recognizing such facts without a party's assertion violates the principle of party presentation. This argument is without merit.

2. As to Ground 2 (Misapprehension of Legal Principles)

A.
Since a disciplinary action taken by an employer against an employee is a penalty imposed as a sanction for the employee's violation of corporate order, and in light of the fact that even in the employer's own re-examination procedure, the disciplinary action may be rescinded (see, e.g., this Court's Decision 91Nu11698, dated May 11, 1993), when the employer itself recognizes that there was an error in the disciplinary procedure, in the recognition of grounds for discipline, or in the unfairness of the disciplinary measure, it may rescind the disciplinary action on its own initiative without waiting for a remedial order from the Labor Relations Commission or a court judgment confirming its invalidity (see, e.g., this Court's Decisions 91Da43558, dated August 14, 1992, and 87Daka2132, dated May 23, 1989), and furthermore, it is also possible for the employer to thereafter take a new and lawful disciplinary action (see this Court's Decision 80Da2945, dated May 26, 1981).

Moreover, once a disciplinary dismissal is rescinded, it is to be treated retroactively as if the employee had never been dismissed, in the same manner as when a judgment confirming the invalidity of the dismissal becomes final (see the above Decision 91Nu11698, dated May 11, 1993); therefore, the fact that a new disciplinary action is subsequently taken based on the same grounds or on newly added grounds cannot be deemed to violate the principle of double jeopardy (ne bis in idem) or the principle of good faith (see the above Decision 80Da2945, dated May 26, 1981), nor can it be said that rescinding a disciplinary action after a judgment confirming the invalidity of the discipline has been rendered constitutes an evasion of the court's judgment.

Although there are some inappropriate points in the reasoning of the court below, its rejection of the Plaintiff's argument on the same grounds is, as a result, justified.

B. Furthermore, the proviso of Article 3, Subparagraph 4 of the Trade Union Act (노동조합법), which provides that "an employee who is contesting the validity of a dismissal shall not be construed as a person who is not an employee," is a provision aimed at protecting the establishment and continued existence of a trade union and preventing the union's activities from being obstructed by the employer's unjust exercise of personnel authority, and it prescribes the qualifications for becoming a member of a trade union; therefore, it applies only in relation to the status as a union member, and cannot be extended in its application to the general validity of the individual employment contract between the employee and the employer (see this Court's Decisions 92Da42354, dated June 8, 1993; 91Da14413, dated March 31, 1992; and 91Do3051, dated May 8, 1992). However, an employee who is contesting the validity of the dismissal through legal proceedings within a reasonable period after the dismissal does not fall under the category of a "third party" whose intervention in industrial actions is prohibited, and thus retains the status of an employee or union member who may participate in industrial action (see the above Decision 91Do3051, dated May 8, 1992, and Decision 89Do1579, dated November 27, 1990); to that extent, even a dismissed employee has an obligation to comply with the company's regulations or statutory provisions relating to industrial action, and accordingly, if such an employee participates in an illegal industrial action, he cannot avoid liability therefor. Therefore, conduct involving participation in an illegal industrial action may constitute grounds for discipline even if the dismissal is later found to be invalid and the employee's status as an employee is restored.

While it was inappropriate for the court below to hold, based solely on the interpretation of the above provision, that the Plaintiff retained the status of an employee, its conclusion that the Plaintiff's act of participating in the instant illegal strike could be used as grounds for discipline is, after all, justified. This argument is without merit in its entirety.

3. As to Ground 3 (Omission of Judgment)

Although the court below erred in failing to render a judgment on the Plaintiff's arguments made in the court below—namely, that the process of investigating the grounds for the instant dismissal and imposing the new disciplinary action was extremely negligent and significantly violated the principle of good faith, and that the disciplinary measure violated the principle of equity—since, where the rules of employment or other disciplinary regulations do not provide for procedures such as giving the person subject to discipline an opportunity to appear and make statements, the disciplinary action is not affected in its validity even if such procedures were not followed (see, e.g., this Court's Decision 91Da14406, dated October 9, 1992), it cannot be said that the failure to follow any particular procedure in investigating the grounds for discipline or in the disciplinary process violates the principle of good faith. Furthermore, in light of the nature of the instant strike and the degree of the Plaintiff's participation in the illegal strike, as established by the facts found by the court below, it cannot be said that the disciplinary dismissal of the Plaintiff exceeded or abused the scope of the disciplinary authority.

Moreover, according to the descriptions in, among others, Exhibit Ka No. 34-1 and 2 (list of names) and Exhibit Ka No. 36-5 (the so-called organizational chart of the democratic union), the persons referred to by the Plaintiff are merely listed as members of the strike leadership (central committee members or department-level leadership committee members), and there is no evidence to show that their actual degree of participation in the illegal strike was more serious than that of the Plaintiff.

Accordingly, since it is clear that the Plaintiff's above arguments are, in the end, without merit and are to be rejected, the aforementioned error of the court below did not affect the outcome of the judgment and thus cannot constitute grounds for reversal (see this Court's Decision 92Da10698, dated June 26, 1992). This argument is also, in the end, without merit.

4. Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the Plaintiff, who lost the appeal, the opinions of the Justices participating in this decision being unanimous, as set forth in the Order.

Justice Kim Hyung-seon (Presiding Justice), Park Man-ho (Justice in Charge), Park Jun-seo, Lee Yong-hun
