Workers, protesting the company's order to work 8 hours on a Saturday, worked only 6 hours and then walked off the job site as a group. When the company issued suspension-from-duty (정직) disciplinary measures in response, the workers sought to have the suspensions declared invalid. The Supreme Court ruled that the company's work order was lawful and that the workers' collective walkout constituted an illegal labor dispute action (쟁의행위), and therefore upheld the validity of the suspension measures.

Key takeaways
  • CaseWorkers walked off the job in protest of a Saturday 8-hour work order and were subsequently suspended by the company.
  • OutcomeThe Supreme Court held the work order lawful and the walkout an illegal strike, upholding the suspension as valid.
  • LessonEmployees should follow legal dispute procedures (such as observing cooling-off periods) rather than resorting to unauthorized collective action, even when they disagree with a work order.
Issues
  • Whether ordering 8 hours of work on a Saturday in a week containing a paid holiday violates the Labor Standards Act (근로기준법)
  • Whether the workers' collective departure from the workplace constitutes an illegal labor dispute action (쟁의행위)
  • Whether failure to provide workers an opportunity to appear and make statements during the disciplinary procedure renders the disciplinary action invalid
  • Whether the suspension from duty (정직) constitutes an unfair labor practice (부당노동행위)
Key reasoning

Because the week in question included a paid holiday, ordering 8 hours of work on Saturday still kept actual working hours at 40 hours for the week, not exceeding the 46-hour weekly limit under the Labor Standards Act (근로기준법), making the order lawful. The workers' collective departure from the workplace, despite attempts by both the company and the labor union chairman to stop them, was carried out without observing the required cooling-off period, rendering it an unlawful labor dispute action. Since the underlying conduct was itself illegal, the company's suspension of the workers as a disciplinary measure was justified. The court also found no basis to invalidate the disciplinary action merely because the workers were not given an opportunity to appear and state their case during the disciplinary process.

Summary of Decision (English, AI translation)

A. Article 42(1) of the Labor Standards Act (근로기준법) provides that working hours, excluding rest hours, shall not exceed 8 hours per day and 44 hours per week, and Article 3(1) of its Addenda provides that the 44-hour weekly working hours under Article 42(1) shall be 46 hours until September 30, 1991 for businesses or workplaces with fewer than 300 employees in industries designated by the Minister of Labor, and until September 30, 1990 for other businesses or workplaces. Here, "working hours" refers to the time during which an employee provides labor under an employment contract under the direction and supervision of the employer, i.e., actual working hours.

B. Where, after collective bargaining between the labor union and the company over the method of implementing the 46-hour workweek system following the amendment of the Labor Standards Act broke down, the company issued a work order to temporarily implement the 46-hour workweek system until an agreement was reached between labor and management, providing that during a week containing a paid holiday other than Sunday, employees would also work 8 hours on Saturday, the case held that such work order could not be deemed to violate the provisions on the 46-hour workweek system under the said Act.

C. In the case under item "B" above, after the labor union resolved by a show of hands to work only 6 hours on Saturdays of weeks containing a paid holiday, and despite the company's and the union leader's attempts to dissuade them, more than half of the union members left the workplace after working 6 hours on Saturday, thereby impeding the normal operation of the company's business, the case held that it was reasonable to view such unauthorized departure as an industrial action subject to restrictions under the Labor Dispute Adjustment Act

D. If the rules of employment or other regulations concerning disciplinary action do not provide for procedures such as giving the person subject to disciplinary charges an opportunity to appear and make statements, a disciplinary action taken without going through such procedures cannot be held invalid on that ground alone.

E. Where the labor union's resolution to decide on the collective departure of employees was adopted by a show of hands, and the employees left the workplace collectively during working hours without going through a cooling-off period, such act constitutes an unlawful industrial action and cannot be regarded as a legitimate act for the union's business; therefore, the case held that it was difficult to view the suspension from work imposed on the employees who led this act as constituting an unfair labor practice.

[Defendant, Appellee] Han Kuk Pigeon Co., Ltd., Attorneys Lee Jae-hu and 3 others, Litigation Representatives
[Judgment Below] Seoul High Court Judgment 90Na46736 dated March 29, 1991

[Order]

The appeal is dismissed.
The costs of the appeal shall be borne by the Plaintiff.

[Reasoning]

The grounds of appeal are examined.

(1) Article 42, Paragraph 1 of the Labor Standards Act (근로기준법, as amended by Act No. 4099 on March 29, 1989) provides that working hours, excluding rest periods, shall not exceed 8 hours per day and 44 hours per week, and Article 3, Paragraph 1 of its Addenda provides that the 44-hour weekly working hours prescribed in Article 42, Paragraph 1 shall be 46 hours until September 30, 1991 for businesses or workplaces with fewer than 300 employees in industries designated by the Minister of Labor, and until September 30, 1990 for other businesses or workplaces. Here, "working hours" refers to the time during which an employee provides labor under an employment contract under the direction and supervision of the employer, i.e., actual working hours.

According to the facts lawfully established in the first instance judgment cited by the court below, Article 16 of the Defendant company's Rules of Employment provides that the working hours of the Defendant company's employees are from 09:00 to 18:00 every day, with actual working hours excluding rest periods set at 8 hours per day and 48 hours per week. Although the amended Labor Standards Act came into effect such that working hours could not exceed 8 hours per day and 46 hours per week, the Defendant company delayed implementation of this. When the Defendant company's labor union demanded a 6-hour workday on Saturdays, the Defendant company held five rounds of collective bargaining with the labor union regarding the method of implementing the 46-hour workweek system, but the negotiations broke down. On September 30, 1989, the company announced its policy that, pending agreement between labor and management on the method of implementing the 46-hour workweek system, the 46-hour workweek system (6-hour workday on Saturdays) would be provisionally implemented from October 1, 1989, but that in weeks including a paid holiday other than Sunday, employees would work normally for 8 hours on Saturday as well, and ordered employees to work accordingly. Given these facts, working hours on paid holidays other than Sunday should be deemed not included in actual working hours. Therefore, even if the company ordered 8 hours of work on the Saturday of a week that included a paid holiday other than Sunday, the actual working hours in that case would be 40 hours (8 hours × 5 days), and thus such a work order is difficult to view as violating the provisions of the Labor Standards Act regarding the 46-hour workweek.

In this vein, the court below's determination that the order to work 8 hours on the Saturday of a week including a paid holiday does not violate the provisions of the Labor Standards Act is justified, and there is no error of misapprehending the law regarding working hours under the Labor Standards Act, as argued in the grounds of appeal. This argument is without merit.

The court below's statement that even if the 8-hour work order for Saturday were, hypothetically, found to violate the 46-hour workweek system under the Labor Standards Act, this would not immediately render the work order unlawful, is merely a hypothetical determination premised on the unlawfulness of the Saturday 8-hour work order in this case. As stated above, since the work order is lawful, this Court shall omit its determination on this point.

(2) Under the Labor Dispute Adjustment Act (노동쟁의조정법), "labor dispute act" means a strike, slowdown, lockout, or any other act performed by parties to a labor relationship for the purpose of achieving their demands, and any act countering such act, which impedes the normal operation of business (Article 3 of the Labor Dispute Adjustment Act).

The first instance judgment cited by the court below found the following facts: when the Defendant company issued an order on September 30, 1989 for employees to work 8 hours on Saturdays in weeks including a paid holiday other than Sunday, the Defendant company's labor union held an extraordinary general meeting on October 6 of the same year, and among approximately 100 registered union members, 59 members, including the Plaintiff and the Selected Parties, attended, and by a show-of-hands vote, 55 members voted in favor of a resolution that although October 3 of the same year was National Foundation Day, a paid holiday (Article 18 of the Rules of Employment), they would work only 6 hours on Saturday, October 7 of the same year, and then leave work, and notified the Defendant company of this on October 7 of the same year. In response, the Defendant company notified the labor union in writing that it could not recognize the union's resolution, as it had no legal basis and had not been agreed upon with the Defendant company, and informed all employees of this through an in-house broadcast. Even though the union chairman at the time, a non-party, emphasized that the unauthorized departure from work refusing normal work was illegal and appealed for normal work, the Plaintiff and the Selected Parties took the lead, and as a result, on Saturday, October 7 of the same year, 63 union members out of approximately 160 employees left the workplace without authorization after working 6 hours. The first instance court also found that the Defendant company posted notices and sent certified mail regarding the unauthorized departure from the workplace, requiring the union members who left without authorization to submit letters of reflection, but all of them refused to do so.

In light of the record, the court below's fact-finding as described above is justified and acceptable. Furthermore, given these facts, it cannot but be found that, absent special circumstances, the normal operation of the Defendant company's business was impeded by the departure from the workplace of the Plaintiff, the Selected Parties, and the other 63 union members, and it is reasonable to view such departure from the workplace as a labor dispute act subject to the restrictions under the Labor Dispute Adjustment Act.

Therefore, the court below's determination that the act of the Plaintiff and the Selected Parties leaving the workplace constitutes a labor dispute act under the Labor Dispute Adjustment Act is justified and acceptable, and there is no error of misapprehending the law regarding labor dispute acts, as argued in the grounds of appeal. This argument is without merit.

(3) (A) It is the view of this Court that, where the provisions on disciplinary action in the Rules of Employment, etc. do not provide for a procedure such as granting the person subject to disciplinary charges an opportunity to appear and make statements, a disciplinary action taken without following such a procedure cannot be held invalid on that ground alone (see this Court's Judgments 85Da375, 85Daka1591 dated July 8, 1986; 90Daka27402 dated April 9, 1991).

The first instance judgment cited by the court below, in this vein, held that under Article 44 of the Defendant company's Rules of Employment, disciplinary action is only required to go through a resolution of the disciplinary committee, and since there is no provision for a procedure such as granting the person subject to disciplinary charges an opportunity to appear and make statements, the disciplinary action cannot be held invalid even if taken without following such a procedure. This determination is justified, and there is no error of misapprehending the law regarding disciplinary procedure, as argued in the grounds of appeal. This argument is without merit.

(B) The first instance judgment cited by the court below held that the mass departure from work that gave rise to the disciplinary action in this case was instigated by union leaders, including the Plaintiff and the Selected Parties, who actively incited the general union members to take the lead, and since the degree of involvement of the Plaintiff and the Selected Parties was greater than that of the general union members, it was justified to impose upon them the heavier disciplinary measure of suspension, as compared to the pay reduction imposed on the general union members. In light of the record, such findings and determination are justified and acceptable, and there is no error in violation of the rules of evidence or misapprehension of the law regarding the scope of disciplinary authority, as argued in the grounds of appeal. This argument is without merit.

(4) The mass departure from work by the Plaintiff and the Selected Parties in this case was a labor dispute act for the reduction of working hours pursuant to the resolution of the Defendant company's labor union, and while this may appear to have been for the business of the labor union, as stated above, ordering 8 hours of work on Saturday in a week including a paid holiday other than Sunday cannot be viewed as unlawful or unjust. Moreover, the resolution of the Defendant company's labor union's extraordinary general meeting of October 6, 1989, which decided on the mass departure, was adopted by a show-of-hands vote rather than by the secret, unsigned ballot method required under Article 12, Paragraph 1 of the Labor Dispute Adjustment Act, and the collective departure from the workplace during working hours occurred without going through the cooling-off period prescribed in Article 14 of the same Act. Accordingly, this constitutes an unlawful labor dispute act that impedes the normal business of the Defendant company, and it is difficult to view it as a "legitimate act" for the business of the labor union. As noted above, the suspension imposed on the Plaintiff and the Selected Parties who led the mass departure from work in this case is not seen as particularly severe compared to the pay reduction imposed on the other union members, and thus it cannot be said that there was an imbalance in the disciplinary measures taken. Accordingly, it is difficult to find that the suspension imposed on the Plaintiff and the Selected Parties constitutes an unfair labor practice.

The determination made in this vein by the first instance judgment cited by the court below is justified and acceptable, and there is no error of misapprehending the law regarding unfair labor practices, as argued in the grounds of appeal. This argument is without merit.

(5) Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the losing party. This judgment is rendered as stated in the Order by the unanimous opinion of the participating Justices.
