This Supreme Court precedent established the principle that when calculating severance pay (퇴직금) for a worker who transitioned from daily/casual employment to regular employment, the entire period of employment must be counted as continuous service. However, if the worker's job classification (직류) changed during that time, the severance pay rate applicable at the time of retirement should be used for the calculation. The court also ruled that any amendment to retirement benefit regulations (퇴직급여규정) that disadvantages workers requires the consent of the labor collective (근로자집단).

Key takeaways
Issues
  • Whether a daily/casual worker (일용직 근로자) working limited days per month can be recognized as a regular employee (상용근로자)
  • How to calculate severance pay (퇴직금) when there has been a change in job classification (직류변경) during employment
  • Whether an unfavorable amendment to workplace rules (취업규칙) is valid without the consent of the labor collective (근로자집단)
  • Whether periods of temporary employment and regular employment should be combined (통산) when calculating total years of service
Key reasoning

The court held that a worker who works even as few as 4-5 to 15 days per month can still be recognized as a regular employee (상용근로자) for the purposes of continuous service calculation, rather than being treated merely as casual labor. When there has been a change in job classification during employment, the total period—including both the casual and regular employment phases—must be combined, but the severance pay rate in effect at the time of the employee's final retirement (based on the job classification held at that time) should be applied. This approach was found to be consistent with the purpose of the Labor Standards Act (근로기준법). Additionally, the court reaffirmed the well-established principle that any unfavorable amendment to workplace rules (취업규칙), including retirement benefit provisions, is invalid unless it has been agreed to by the collective body of affected workers.

Summary of Decision (English, AI translation)

[1] Originally, it is not necessarily required that a worker work at least 25 days per month on average in order to satisfy the requirements of regularity, continuity, and subordination of a worker, which are prerequisites for the payment of retirement allowance under the Labor Standards Act (근로기준법); if a worker has worked continuously for at least about 4, 5 to 15 days per month, the above requirements are satisfied.

[2] Even if a worker is formally classified as a daily worker, if the daily employment relationship has continued without interruption, the worker must be regarded as a regular worker.

[3] Where an employment contract is renewed simultaneously with its expiration, or where employment contracts with the same conditions are repeatedly concluded, the periods of the renewed or repeated contracts must all be aggregated in calculating the number of years of continuous service.

[4] Even where there is a change in the form of work provision (job type or job category) during the period of service, such as where a worker, having been hired as a temporary employee, was subsequently hired as a regular employee in the middle of employment and continued to work without any gap, the period combining the service period as a temporary employee and the service period as a regular employee must be regarded as the continuous years of service forming the basis for calculating the retirement allowance.

[5] [Majority Opinion] Regarding the method of calculating retirement allowance where there has been a change of job category in the middle of the continuous service period and the retirement allowance payment rate differs according to job category: if there are provisions in the rules of employment or collective agreement concerning such calculation method, and such provisions do not violate Article 28(1) of the Labor Standards Act, it is lawful to follow those provisions; however, where no such separate provisions exist, the method must be derived through interpretation of the rules of employment and collective agreement concerning retirement allowance calculation at the workplace concerned, and in this process Article 28(1) of the Labor Standards Act must be taken as the most important standard of interpretation. According to that provision, the fundamental elements in calculating retirement allowance are the three factors of continuous years of service, the retirement allowance payment rate, and the average wage at the time of retirement. Since, notwithstanding the change of job category during the retiring worker's period of service, the entire period during which he continuously worked must be regarded as the continuous service period, and since the average wage forming the basis of the retirement allowance calculation must, pursuant to Article 19(1) of the Labor Standards Act, be calculated based on the wages for the three months prior to retirement, that is, the average wage at the time of retirement after the change of job category, it follows that the payment rate likewise should be the payment rate of the job category at the time of retirement, in conformity with the purport of Article 28(1) of the Labor Standards Act. Accordingly, Supreme Court Decision 93Da11654, delivered on February 22, 1994, which took a different view, is hereby overruled.

[Dissenting Opinion] In a workplace where the retirement allowance payment rate differs according to job category, where there has been a change of job category during the continuous service period and there are no provisions whatsoever in the rules of employment, collective agreement, or the like concerning the method of calculating retirement allowance in accordance with such change of job category, it cannot be said that the content of the rights and obligations between the employer and the worker concerning retirement allowance already established prior to the change of job category is naturally and retroactively altered by the change of job category. In such a case, it is correct to: calculate, for the period of service prior to appointment as a regular employee, the number of days of retirement allowance payment according to the retirement allowance payment rate applicable to temporary employees, or, pursuant to Article 28(1) of the Labor Standards Act, at the simple rate (in a case where there is no retirement allowance provision applicable to temporary employees); and calculate, for the period after appointment as a regular employee, the number of days of retirement allowance payment according to the retirement allowance payment provisions applicable to regular employees (by subtracting, from the number of days of retirement allowance payment calculated by applying the regular employee retirement allowance payment rate to the entire period of service, the number of days of retirement allowance payment calculated by applying the regular employee retirement allowance payment rate to the period of service as a temporary employee); then calculate the total number of days of retirement allowance payment by adding the above-calculated numbers of days of payment, and calculate the amount of the retirement allowance by multiplying this total by the average wage at the time of retirement. This interpretation is also consistent with the Supreme Court's precedents to date (Supreme Court Decision 74Da1840, delivered on July 22, 1975; Supreme Court en banc Decision 77Da1137, delivered on September 28, 1977), and, in light of the normative character of the rules of employment (see Supreme Court Decision 77Da355, delivered on July 26, 1977), it is also consistent with this Court's view (Supreme Court Decision 89Daka15939, delivered on November 27, 1990) concerning the scope of application of the rules of employment, that except where the retirement benefit provisions, etc. specifically provide otherwise, the content of the right to retirement allowance already established according to the form of work already provided is not retroactively altered by subsequently amended rules of employment or retirement benefit provisions, etc.

[6] At the time of the disadvantageous amendment of the retirement benefit provisions, no labor union had been established, the workplaces were scattered throughout the country, and the number of employees reached 1,893, making it practically impossible to obtain the consent of all workers through a collective decision-making method within a short period of time; even though the deliberation and resolution of the board of directors was undergone in accordance with the company's articles of incorporation and board of directors' operating rules, this is merely a procedure to be followed from the standpoint of the employer, and the consent of the worker group is likewise still required.

[7] Even if, after the rules of employment were amended disadvantageously to workers, the retired workers or the labor union composed of the company's workers did not raise any particular objection to the amendment of the rules of employment thereafter, and the amended provisions have accordingly been implemented as they are, this circumstance alone cannot be deemed to conclusively establish that the workers subsequently ratified the amended provisions or impliedly consented thereto.

[8] Example of a case holding that the lower court's determination was justified, where the lower court determined that, even though the reason for disadvantageously amending the retirement benefit provisions was to rectify the sense of disparity arising because the company's retirement benefit provisions were higher than those of general public officials or other corporate entities, and to comply with a policy adopted by the government in order to escape the deficit operation of government-invested institutions, it did not appear that there existed social reasonableness sufficient to dispense with the need to obtain the consent of the worker group.

[9] Where a labor union, established after the retirement benefit provisions had been disadvantageously amended without the consent of the worker group, concluded a collective agreement with the company, and, without knowing that the rules of employment then in effect were invalid, merely included a supplementary provision in the collective agreement stating that "matters not specified in this agreement shall be governed by the relevant laws and regulations and practices," this alone cannot be deemed to constitute ratification of the amendment of the invalid retirement benefit provisions.

[10] Where, up to the lower court, the party only asserted that the retirement allowance should be calculated according to the amended retirement benefit provisions, and the assertion that the average wage under the pre-amendment retirement benefit provisions differs from the average wage under the Labor Standards Act is a new factual assertion raised for the first time at the final appeal stage, since this point was not asserted in the lower court, it cannot constitute a legitimate ground for final appeal.

[11] If the family allowance is an obligation that the company is required to pay, and has been uniformly paid to workers who meet certain requirements, this is not a discretionary or gratuitous payment but constitutes wages having the nature of remuneration for labor.

[Plaintiff, Appellee] Plaintiff
[Defendant, Appellant] Korea National Housing Corporation (대한주택공사) (Litigation representative: Attorney Kim Chan-jin and one other)
[Court below] Seoul High Court Decision 92Na45263 rendered on April 23, 1993

[Order]

The appeal is dismissed.
The costs of the appeal shall be borne by the Defendant.

[Reasoning]

The grounds of appeal and the portions of the supplementary brief on grounds of appeal submitted after the expiration of the period for submitting the grounds of appeal that supplement the grounds of appeal are judged together.

1. As to Ground One

A. Examining the reasoning of the judgment below in light of the record, it is proper that the court below, comprehensively considering the evidence cited in its judgment, found the fact that the Plaintiff was employed on May 24, 1965 as a daily-wage temporary employee at the ○○○○○ Housing Management Office under the Defendant Corporation, and thereafter worked until December 31, 1977, being re-hired each year at the beginning of the year under a one-year fixed-term employment arrangement, during which he sometimes worked as a janitor or assistant gardener but mainly worked as a boiler-room mechanic; that he retired from the temporary employee position on December 31, 1977; that he was hired as a regular technical staff member on January 1, 1978 and continued to engage in the same mechanic duties as before; and that he retired upon reaching the mandatory retirement age on October 31, 1989. There is no error in violation of the rules of evidence. The portion of the grounds of appeal relating to this point is without merit.

B. It is not necessarily the case that a worker must work an average of 25 or more days per month in order to satisfy the requirements of regularity, continuity, and subordination of a worker that form the premise for retirement allowance payment under the Labor Standards Act (근로기준법); rather, working continuously for at least 4 to 5 days to 15 days per month satisfies these requirements (see Supreme Court Decision 78Da2089 rendered on January 30, 1979). In such a case, continuity of the employment relationship is not recognized only where the content of the work performed during the daily-employment period is identical or similar to the content of the work performed during the regular technical staff period. Although Defendant's Exhibits Eul No. 2-1 through 2-95 (each work slip), pointed out in the grounds of appeal, are unclear as to whether they cover the entire period during which the Plaintiff worked as a daily employee, even according to this evidence it is recognized that the Plaintiff worked continuously as an assistant mechanic in 1973, and as a mechanic from 1974 through the end of 1977, and that even up to 1972 he worked most months for about 15 days as a janitor, special laborer, pruner, etc. Therefore, the period during which the Plaintiff worked before 1973 should also be recognized as part of the continuous service period. The judgment of the court below to this effect is proper, and the portion of the grounds of appeal pointing out this issue is without merit.

C. Even where, in form, a worker is classified as a daily worker, if the daily employment relationship has continued without interruption, the worker must be regarded as a regular worker (see Supreme Court Decisions 76Da1812 rendered on September 14, 1976; 83Daka657 rendered on August 19, 1986, etc.), and where, upon expiration of an employment contract, the contract term is renewed or an employment contract of the same conditions is repeatedly concluded, the periods of the renewed or repeated contracts must all be aggregated in calculating the years of continuous service (see Supreme Court Decisions 74Da1625, 1626 rendered on June 24, 1975; 78Da1753 rendered on April 10, 1979, etc.). Furthermore, even where there is a change in the form of work provided (job type or job classification) during the period of service, such as where a person hired as a temporary employee is later hired as a regular employee and continues to work without any gap, the period combining the service period as a temporary employee and the service period as a regular employee must be regarded as the years of continuous service that form the basis for calculating the retirement allowance (see Supreme Court Decision 80Da617 rendered on May 27, 1980).

Where, as above, there is a change in job classification during the continuous service period and there is a difference in the retirement allowance payment rate depending on the job classification, if the rules of employment or collective agreement contain provisions on the method of calculating retirement allowance in such a case, and such provisions do not violate Article 28, Paragraph 1 of the Labor Standards Act (hereinafter "the Act"), it is lawful to follow those provisions. However, where, as in this case, the rules of employment or collective agreement do not contain separate provisions on the method of calculation, the method must be derived through interpretation of the rules of employment and collective agreement concerning retirement allowance calculation at the workplace in question, and in this process, Article 28, Paragraph 1 of the Act must be taken as the most important criterion for interpretation. Article 28, Paragraph 1 of the Act provides: "An employer shall establish a system whereby an average wage of not less than 30 days' worth for each year of continuous service is paid as a retirement allowance to a retiring worker: Provided, That this shall not apply where the years of service are less than one year." Accordingly, the basic elements in calculating retirement allowance are the years of continuous service, the retirement allowance payment rate, and the average wage at the time of retirement. Given that, notwithstanding a change in job classification during the retiree's period of service, the entire period of continuous work is regarded as the continuous service period, and the average wage forming the basis for calculating the retirement allowance is also calculated based on the wages for the three months prior to retirement pursuant to Article 19, Paragraph 1 of the Act—that is, based on the average wage at the time of retirement after the change in job classification—it accords with the purport of Article 28, Paragraph 1 of the Act that the payment rate should also naturally be the payment rate of the job classification at the time of retirement. It is not the case that, merely because the retirement allowance payment rate of the job classification before the change differs from that of the job classification after the change, the retirement allowance must be calculated by dividing the periods worked in each job classification and applying separate payment rates only with respect to the payment rate, while treating the other two elements as described above. Even though the legal nature of a retirement allowance is that of deferred wages, since the average wage must inevitably be calculated based on the wage at the time of retirement pursuant to Article 28, Paragraph 1 and Article 19, Paragraph 1 of the Act, there is no theoretical necessity that the retirement allowance payment rate must be based on the rate applicable before the change in job classification. Interpreting the matter in this way respects the legal relationship formed according to the agreement on job classification change between the employer and the worker at a time when there was no provision on this matter in the collective agreement or rules of employment, and therefore there is no room for the issue of infringement of the worker's vested rights to arise. The grounds of appeal to the contrary cannot but be regarded as a misunderstanding of the purport of Article 28, Paragraph 1 and Article 19 of the Act.

Therefore, even where employees are classified into temporary employees and regular employees, with a progressive retirement allowance system applied to regular employees while a separate, different retirement allowance provision applies to temporary employees, or no retirement allowance provision applies to them at all, if a worker's form of work provision (job type or job classification) changes from temporary employee to regular employee and the worker later retires, the amount of the retirement allowance must be calculated by multiplying the average wage as a regular employee at the time of retirement by the payment rate applicable to regular employees at the time of retirement, applied to the entire period of service combining the period worked as a temporary employee and the period worked as a regular employee (see Supreme Court Decisions 80Da3263 rendered on September 8, 1981; 81Daka137 rendered on April 13, 1982; 86Daka1347 rendered on October 28, 1986). Accordingly, Supreme Court Decision 93Da11654 rendered on February 22, 1994, which took a different view, is hereby overruled.

According to the facts found by the court below, the Plaintiff, as noted above, was hired as a daily-wage temporary employee on May 24, 1965 and, until the end of 1977, repeatedly concluded employment contracts of the same conditions each time the one-year employment contract term expired, continuing to work, and his job classification changed from daily employment to regular employment on January 1, 1978. In the case of the Defendant Corporation, a single-rate retirement allowance system applies to daily-wage temporary employees, while a progressive retirement allowance system applies to regular employees. Since the Plaintiff's years of continuous service must be regarded as the entire period combined from the time he was initially hired as a daily-wage temporary employee until he retired as a regular employee, the measure of the court below, which calculated the Plaintiff's retirement allowance based on the retirement allowance payment rate under the retirement allowance regulations applicable to regular employees, the job classification at the time of retirement, applied to the Plaintiff's entire period of service, is proper and in accordance with the repeatedly confirmed views of precedent, and there is no error of misunderstanding the legal principles concerning retirement allowance calculation. The portion of the grounds of appeal pointing out this issue is also without merit.

2. As to Ground Two

According to the reasoning of the judgment below, the court below held that the Defendant Corporation's retirement benefit regulations, having been delegated by the rules of employment, constitute part of the rules of employment; that the amendment to the said regulations effective January 1, 1981, which lowered the retirement benefit payment rate forming the basis for calculating retirement allowances for employees and reduced and restricted the scope of monthly salary, resulting in a reduction of the retirement allowance payment amount, constituted an unfavorable change to the existing working conditions of employees; that since the consent of the employees through a collective decision-making method was not obtained, the amendment to the said regulations has no effect as to the Plaintiff, who was subject to the pre-amendment regulations; that, even though there was no labor union established at the time of the amendment of the said regulations, and the workplaces were scattered nationwide, and the number of employees reached 1,893, making it practically impossible to obtain the consent of all workers through a collective decision-making method within a short period of time, and even though the amendment was passed through deliberation and resolution of the board of directors pursuant to the Defendant's articles of incorporation and board of directors operation regulations, this was merely a procedure to be followed from the employer's standpoint, and the consent of the group of workers was still required; that even if, after the rules of employment were amended unfavorably to workers, the retired workers or the labor union of the Defendant Corporation composed of workers did not subsequently raise any particular objection to the amendment of the rules of employment, and the amended regulations were implemented as they were, this circumstance alone cannot be deemed to mean that the workers subsequently ratified the amended regulations or gave implied consent thereto; and that even if the reason for amending the said regulations was to correct the sense of relative deprivation arising from the fact that the Defendant's retirement benefit regulations were higher than those of general public officials or other corporate bodies, and to comply with the government's policy adopted to escape the deficit operation of government-invested institutions, this does not appear to have such social reasonableness as would obviate the need to obtain the consent of the group of workers. The above determination of the court below is proper, and there is no error of misunderstanding the legal principles concerning unfavorable changes to rules of employment.

Furthermore, even if the labor union of the Defendant Corporation, established after the retirement benefit regulations were unfavorably amended without the consent of the group of workers as above, concluded a collective agreement with the Defendant Corporation without knowing that the rules of employment then in effect were invalid, and included a provision in the supplementary provisions of the collective agreement that matters not specified in the agreement shall be governed by relevant laws and customary practice, this alone cannot be deemed to constitute ratification of the amendment of the invalid retirement benefit regulations (see Supreme Court Decision 92Da32357 rendered on November 27, 1992). Moreover, according to the statements in Defendant's Exhibits Eul No. 28-1 through 4 and No. 29-1 through 5, the content of the amendment to the rules of employment concerned only matters such as work attitude, annual/monthly leave, and holidays, which have nothing to do with retirement allowance, so the fact that the labor union communicated that it had no opinion on this matter cannot be deemed to constitute ratification of the amendment of the invalid retirement benefit regulations. Therefore, the portion of the grounds of appeal asserting that the amendment of the rules of employment became effective through ratification is also without merit.

3. As to Ground Three

The Defendant, up to and including the proceedings before the court below, merely argued that the Plaintiff's retirement allowance should be calculated in accordance with the amended retirement benefit regulations; the argument that the average wage under the pre-amendment retirement benefit regulations differs from that under the Labor Standards Act is a new factual assertion raised for the first time at the appellate stage, and since it was not raised in the court below, this point cannot constitute a legitimate ground of appeal (see Supreme Court Decision 92Da24325 rendered on September 25, 1992).

Furthermore, according to the record, it can be recognized that the family allowance pointed out in the grounds of appeal is also an obligation of the Defendant to pay, and has been uniformly paid to workers who meet certain requirements; therefore, this is not a discretionary or gratuitous payment but has the nature of consideration for labor and thus constitutes wages (see Supreme Court Decision 84Daka1409 rendered on February 24, 1987). Accordingly, the portion of the grounds of appeal asserting that the said family allowance does not constitute wages under the Labor Standards Act is also without merit.

4. Therefore, the appeal is dismissed, and the costs of the appeal are to be borne by the Defendant, the appellant. With respect to the determination in "1.C." above, there being a dissenting opinion by Justices Kim Seok-su, Jeong Gwi-ho, and Park Jun-seo, and the opinions of the other participating Justices being unanimous otherwise, the judgment is rendered as set forth in the Order.

5. Justices Kim Seok-su, Jeong Gwi-ho, and Park Jun-seo do not concur with the majority opinion's determination on "1.C." above, for the following reasons.

In a workplace where, as in this case, the retirement allowance payment rate differs depending on job classification, and there is a change in job classification during the continuous service period, and there is no provision in the rules of employment or collective agreement, etc. concerning the method of calculating the retirement allowance according to such change in job classification, the content of the rights and obligations of the employer and worker regarding the retirement allowance that had already accrued before the change in job classification cannot be deemed to be naturally and retroactively altered by the change in job classification. In such a case, it is proper to calculate the number of days of retirement allowance payment for the period of service prior to appointment as a regular employee in accordance with the retirement allowance payment rate applicable to temporary employees, or the simple rate under the provisions of Article 28, Paragraph 1 of the Labor Standards Act (where there is no retirement allowance provision applicable to temporary employees), and to calculate the number of days of retirement allowance payment for the period after appointment as a regular employee in accordance with the retirement allowance payment provisions applicable to regular employees (by subtracting the number of days of retirement allowance payment calculated by applying the regular employee retirement allowance payment rate to the period of service as a temporary employee from the number of days of retirement allowance payment calculated by applying the regular employee retirement allowance payment rate to the entire period of service), and then adding the numbers of days of retirement allowance thus calculated to obtain the total number of days of retirement allowance payment, and multiplying this by the average wage at the time of retirement to calculate the amount of the retirement allowance. Supreme Court Decisions 91Da34530 rendered on April 14, 1992 and 91Da3895 rendered on April 23, 1991 also appear to be premised on this same view.

This interpretation accords with the Supreme Court precedents to date that regard retirement allowance as deferred wages (see Supreme Court Decisions 74Da1840 rendered on July 22, 1975; 77Da1137 (en banc) rendered on September 28, 1977, etc.), and also accords with this Court's view on the scope of application of rules of employment, in light of the normative character of rules of employment (see Supreme Court Decision 77Da355 rendered on July 26, 1977), that, except where the retirement benefit regulations, etc. specifically provide otherwise, the content of the right to retirement allowance already accrued according to the form of labor already provided is not retroactively altered by subsequently amended rules of employment or retirement benefit regulations, etc. (see Supreme Court Decision 89Daka15939 rendered on November 27, 1990).

To apply, as the majority opinion does, the retirement allowance payment rate according to the job classification at the time of retirement to the entire period of continuous service is tantamount to deeming that a form of labor not actually provided was provided with respect to the period of service prior to the change in job classification, which cannot be deemed proper. Nor can we agree with the majority opinion that interpreting the retirement allowance payment rate, in the case of a change in job classification, as having been agreed to be the payment rate of the job classification at the time of retirement accords with the purport of Article 28, Paragraph 1 of the Labor Standards Act.

Originally, Article 28, Paragraph 1 of the Labor Standards Act, with respect to the payment of retirement allowance, merely provides that an average wage of "not less than 30 days' worth for each year of continuous service" be paid; therefore, insofar as the retirement allowance payment rate does not fall short of this, the Labor Standards Act does not prohibit, in a workplace where the retirement allowance payment rate differs according to job classification as in this case, applying different retirement allowance payment rates according to the respective job classifications when a worker's job classification changes, and interpreting the matter in this way cannot be said to be contrary to the purport of Article 28, Paragraph 1 of the Labor Standards Act.

It is a matter of course, as a matter of legal principle, that when there is a change in a legal relationship, both the purposiveness pursued by the new legal relationship and the legal stability of the pre-existing legal relationship must be taken into account. The general principle presented by law in this regard is the principle of non-retroactivity.

Where the form of labor provision changes and the applicable retirement allowance provisions accordingly differ, it accords with the purpose for which the parties changed the form of labor provision to aggregate the entire period of continuous service and apply, prospectively, the number of days of retirement allowance payment, average wage, etc. according to the new form of labor provision. However, since the number of days of retirement allowance payment according to the past form of labor provision may, depending on the circumstances, be advantageous to the worker or to the employer, such that their interests may diverge, unless the retirement allowance provisions or the intention of the parties is clear, the principle of non-retroactivity should be applied in accordance with the general principles of law to guarantee the legal stability of the parties. Otherwise, the result would be a retroactive infringement of the existing legal status of one of the parties.

For these reasons, we cannot concur with the majority opinion. The views expressed in the Supreme Court decisions cited by the majority opinion should be overruled, and rather, the view expressed in Supreme Court Decision 93Da11654 rendered on February 22, 1994, which the majority opinion overrules, should be maintained as is. Accordingly, the judgment of the court below, which calculated the Plaintiff's retirement allowance based on the retirement allowance payment rate under the retirement benefit regulations applicable to regular employees, the job classification at the time of retirement, applied to the Plaintiff's entire period of service, committed an error of misunderstanding the legal principles concerning retirement allowance calculation that affected the judgment.
